GARBAGE
PERSON
REFUSE
Definitions. The following words, as used in this
article, shall have the meanings hereby ascribed thereto, unless the
context clearly indicates a different meaning:
All table refuse, animal and vegetable matter, offal from
meat, fish and fowls, fruits, vegetables and parts thereof, and other
articles and materials ordinarily used for food which have become
unfit for such use or which are for any reason discarded.
Any natural person, firm, corporation, partnership, association
or institution, except a municipal or other governmental body.
A general term meaning all matter and material which is discarded,
including garbage and noncombustible waste.

Word usage. In this article, the singular shall include
the plural and the masculine shall include the feminine and neuter.

All garbage and refuse originating within the township
shall be disposed of only:

In no case may garbage be brought into the township
for the purpose of disposal therein, nor may garbage be disposed of
within the limits of the township by burning. Pending disposal as
hereby authorized, garbage may be stored in covered containers only
and in such limited quantities and for such limited period of time
as shall ensure that no annoyance, nuisance or health hazard shall
be created or maintained thereby.[1]

All vehicles used within the township for the collection,
transportation or disposal of garbage, refuse or rubbish shall have
enclosed bodies or have the body covered with a tarpaulin or canvas
cover or other suitable cover to prevent the distribution of garbage
or refuse upon the highways or upon abutting lands.

All vehicles used within the township for the collection,
transportation or disposal of garbage or of refuse containing garbage
shall be watertight, have metal or metal-lined bodies or interior
containers, be of easily cleanable construction, be cleaned at sufficient
frequency to prevent nuisance or insect breeding and shall be maintained
in good repair.
No person shall permit any outfalling from the
conveyance of refuse to lie upon any premises or upon or along any
public or private road in the township. Failure of any licensed collector
to remove the same after being notified to do so by the township police
or other township official shall be grounds for immediate cancellation
of such license.

Any person convicted of violation of this article
in a summary proceeding before any District Justice shall pay a fine
of not more than $300, together with costs of prosecution, and, in
default of payment thereof, shall be sentenced to imprisonment in
the county jail for a period not to exceed 30 days, in the discretion
of the Justice before whom the conviction is obtained.
This chapter shall be effective January 1, 1959.
