A.
The New
Hope Borough Fire Marshal, and all authorized designees thereof, is
hereby authorized to administer and enforce the provisions of the
2009 Edition of the ICC International Fire Code for the purposes set
forth in this chapter.
B.
The New
Hope Borough Fire Marshal, and all authorized designees thereof, is
hereby authorized to administer and enforce the provisions of the
2003 Edition of the ICC International Property Maintenance Code for
the purposes set forth in this chapter.

The New Hope Borough Fire Marshal, and all authorized
designees thereof, is hereby authorized and directed to inspect all
assembly, business, educational, factory, high-hazard, institutional,
mercantile, storage and miscellaneous occupancies, as defined in the
2009 Edition of the ICC International Fire Code, on an annual basis
to determine compliance with requirements of such fire code.

A.
The New Hope Borough Fire Marshal, and all authorized designees thereof, is authorized and directed to inspect on an annual basis, to determine compliance with the 2009 Edition of the ICC International Fire Code, and the 2003 Edition of the ICC International Property Maintenance Code, all areas of residential (R-1, R-2, and R-4) occupancies, as identified in Subsection B and defined in the 2009 Edition of the ICC International Fire Code, not used as private or permanent living spaces.
B.
Residential
occupancies subject to the annual inspection and permit requirements
herein are as follows.
(1)
R-1,
residential occupancies where the occupants are primarily transient
in nature, including, but not limited to, boarding houses, hotels,
and motels.
(2)
R-2,
residential occupancies containing sleeping units or more than two
dwelling units where the occupants are primarily permanent in nature,
including, but not limited to, apartment houses, boardinghouses, convents,
dormitories, fraternities and sororities, hotels, monasteries, motels,
and vacation time-share properties.
(3)
R-4,
residential occupancies, including, but not limited to, buildings
arranged for occupancy as residential care/assisted living facilities
of more than five but not more than 16 occupants.
All owners and/or tenants of properties that meet the classification criteria established in §§ 150-2 and 150-3 above shall file an application annually with, and obtain an annual fire safety permit from the office of the Fire Marshal. The issuance of the annual permit shall follow an inspection by the Fire Marshal, who shall find the premises free from any violations of the codes or any other state and/or local law, rule or regulation concerning fire safety.
A.
Issued permits shall be kept on the premises designated
therein at all times and shall be readily available for inspection
by the Fire Marshal.
B.
Annual fire safety permits shall be valid for a period
of one year from the date of issuance, unless a subsequent inspection
by the Fire Marshal demonstrates that a code violation exists at the
premises. The Fire Marshal shall revoke the annual permit upon a finding
that a violation exists and shall not reissue the permit until such
time as the violation is abated.
The Council shall adopt by resolution a fee
schedule for annual fire safety inspection permits.
Any person who shall violate any provision of
this chapter shall, upon conviction thereof, be sentenced to pay a
fine not to exceed $1,000 and costs, or in default of payment thereof,
shall be subject to imprisonment for a term not to exceed 30 days.
Each day a violation of this chapter continues shall constitute a
separate offense. The application of this penalty shall not be held
to prevent the enforced removal of prohibited conditions.

A.
By December
31 of the year of the issuance of a new triennial ICC International
Fire Code, or its successor code, the New Hope Borough Fire Marshal
shall review such edition, and may make a recommendation to the New
Hope Borough Council that it should adopt the updated triennial ICC
International Fire Code or exclude any provisions of such code for
the purposes of this chapter.
B.
Upon receipt
of any such recommendation, or if none is issued, New Hope Borough
Council may adopt by resolution the updated triennial ICC International
Fire Code, with any provisions of such code excluded, as the applicable
fire prevention code for the purposes set forth in this chapter.
