No owner, lessee or occupant of real property shall cause or permit any dried grass, weeds, brush, wastepaper, rags, boxes, barrels or other flammable or combustible waste material to accumulate or remain on the premises under his control or care.
The Fire Inspector shall serve a notice in writing, either personally or by mail, on any owner, lessee or occupant of real property in the Village to remove or destroy any accumulations of such grass, weeds, brush and all other forms of refuse or rubbish thereon likely to cause or spread fires.
A person so served, who for five days after service shall neglect or fail to comply with such notice, shall be deemed to have violated this chapter.
If, after five days from the service of such notice, the owner, lessee or occupant of the real property upon which such wastepaper, rags, boxes, barrels, grass, weeds and other flammable or potentially flammable or combustible waste materials have accumulated shall not have complied with the mandate of such order, the Incorporated Village of Patchogue may, through its employees or contractor, enter upon such premises and remove the accumulation of such materials.
The Board of Trustees, as the Committee on Streets, shall certify to the Treasurer the cost of such removal against the owner of the property; and upon the receipt of the certification of such cost, the Treasurer shall assess and enter as a lien against such property the certified cost thereof and shall within 10 days after the entry of such assessment of liens and notice thereof, demand payment thereof from the person, firm or corporation appearing on the assessment roll as the owner thereof. If such lien shall not be paid within 40 days after the entry thereof, interest shall be payable thereon from the date of entry of such lien at the rate of 1% per month or fraction thereof.
All payments received by the Treasurer for and on account of the cost of cleaning vacant lots in the incorporated limits of the Village of Patchogue, in accordance with the foregoing provisions of this chapter, shall be credited to the Cleaning of Vacant Lots Account.
Should there be a service of an order made under this chapter while an order under Article I of this chapter is outstanding to correct the same condition, the order under Article I shall take precedence.
