The purpose of this article is to provide regulations
and standards applicable to the installation of fire-alarm systems
that require Fire Department response, so as to ensure competent standards
of workmanship and thereby lessen the possibility of false alarms
resulting from malfunctions of unrecognized installations.
For the purpose of this article, the following
terms, phrases and words shall have the meaning given therein:
Any person who is employed by any commercial entity that
is licensed hereunder as an alarm business whose activities include
selling, leasing, installing, repairing, servicing or maintaining
in or on any building, place or premises any fire alarm device within
the Village of Patchogue.
Any business, firm, corporation or other commercial entity
which is in the business of selling, leasing, installing, repairing,
servicing or maintaining a fire alarm device or devices and perform
such services within the Village of Patchogue.
Any person or entity in or on whose premises a fire alarm
device is installed in the Village of Patchogue.
Any private or commercial entity which receives signals from
fire alarm devices within the Village of Patchogue and relays information
pertaining to such fire alarm devices to the appropriate Fire Department
headquarters.
A telephone-interfaced device that automatically connects
to local Fire Department headquarters and transmits a recorded message
to report an emergency condition requiring Fire Department response.
Any fire alarm device which transmits a signal or impulse
through any means received by Fire Departments.
Any alarm activation to which Fire Department personnel respond,
which is not the result of fire, smoke or other emergency.
Any device which, when activated by fire, smoke or other
emergency requiring local Fire Department response, transmits a signal
to local Fire Department headquarters or to a private central alarm
station and/or produces any audible or visible signal to which the
local Fire Department is expected to respond. Excluded from this definition
and from the provisions of this article are devices designed to alert
the occupants of a building of any emergency condition therein and
which do not produce any audible or visible signal which is perceptible
outside of such building.
Any false alarm, as defined herein, which is intentionally
activated by any person.
Any fire alarm device which is not connected directly to
local Fire Department headquarters but which, when activated, causes
an audible or visible signal perceptible to persons on the outside
of the premises within which said fire alarm device is installed.
Fire Department headquarters and other enclosures housing
privately or publicly owned equipment serving the Fire Department
throughout the Village.
The Fire Inspector of the Village of Patchogue.
Unlawful to operate, maintain, install, lease
or sell a fire alarm device without a permit. It shall be unlawful
for any person, business, firm, corporation or other commercial entity
to operate, maintain, install, lease or sell a fire alarm device or
devices or a system of fire alarm devices as defined by the terms
of this article without first obtaining a permit as hereinafter provided.
A.
Any owner or lessee of property in the Village of
Patchogue having on his or its premises a fire alarm device or system
of fire alarm devices shall apply to the permitting authority for
a permit to own or otherwise have such a device on his or its premises.
Such permit need not be renewed unless the alarm device or system
is changed or modified.
B.
Authority to grant permits.
(1)
The permitting authority is hereby authorized to grant
a permit to any applicant to do business in the Village of Patchogue
by performing any or all of the following functions: to own, operate,
maintain, install, lease or sell a fire alarm device or devices or
a system of devices.
(2)
The permitting authority is hereby authorized to grant
a permit to any owner of property located within the Village of Patchogue
or the lessee thereof to operate, maintain, install and modify a fire
alarm device.
C.
Compliance. Owners and lessees of premises presently
having fire alarm devices or systems must comply with all provisions
of this article by such date as shall be fixed by the permitting authority.
Fees for permits required by this article, as
listed below, shall be as set from time to time by resolution of the
Board of Trustees:[2]
A.
The Village assumes no responsibility for such device
or system. Notwithstanding the payment of any fee and/or the issuance
of any permit or license as herein required, the Fire Inspector and
the Village of Patchogue shall be under no obligation whatsoever concerning
the adequacy, the operation or the maintenance of the alarm device
so installed, and the Village of Patchogue and its authorized agents
hereby assume no liability whatsoever for any failure of any such
alarm device or for any act of omission or commission as a result
of any such alarm, device or system.
B.
Automatic dialing devices. Automatic dialing devices
shall transmit messages only to such telephone number(s) as shall
be designated for that purpose by the Fire Inspector.
C.
Timing device. The user of every alarm system emitting
an audible, visible or other similar signal shall install or cause
to be installed an automatic timing device which shall deactivate
such alarm that has been activated within 30 minutes or less.
D.
Limitations of automatic dialing devices. No person
shall use, operate or install any device that will, upon activation,
automatically dial, call or connect with the telephone number designated
by the Fire Inspector for the purpose of receiving such alarm messages
more than twice for any one incident.
E.
Installation and maintenance. The owner or lessee
shall be responsible for the maintenance and service of his or its
fire alarm device equipment and shall be responsible for all malfunctions
of his or its equipment.
F.
Installation compliance. All fire alarm devices and/or
systems shall be installed in accordance with the provisions of this
article, the current issue of the National Electrical Code and the
regulations of the National Fire Protection Association for the installation,
maintenance and use of fire alarm devices and systems.
Prior to actual use of a fire alarm device or
system, a certificate of compliance must be issued by the Fire Inspector
certifying that the following conditions have been met:
A.
The owner or lessee is to furnish appropriate proof
that the fire alarm device and/or system, including wiring and all
component parts, is installed according to all applicable codes and
regulations.
B.
A thorough and complete test of all facets of the
fire alarm device and/or system upon notice to the appropriate local
Fire Department headquarters, is to be made in the presence of the
Fire Inspector.
All fire alarm devices and/or systems, installed
and operating within the Village, are to be tested at least once every
six months pursuant to recognized testing procedures. Said testing
is to be undertaken only after adequate notice has been received by
the local Fire Department headquarters.
A.
It shall be a violation of this article to intentionally
cause a false alarm, and any person or entity who does intentionally
cause a false alarm shall be subject to the penalty provision of § 240.50
of the New York State Penal Law.
B.
After a maximum of four false alarms in any one calendar
year, for whatever reason caused, the owner or lessee of an alarm
device and/or system shall be cited for a violation of this article.
