The purpose of this chapter is to require protective fencing of pits and other excavations which create or have created dangerous or hazardous conditions and represent a danger to people or animals.
No person shall create any pit or other excavation in excess of one foot in depth without providing adequate fencing entirely around the perimeter of the pit or excavation to a height of not less than five feet.

No such excavation shall be commenced until an application has been filed with the Township Engineer containing a detailed statement of the proposed work, together with a plan prepared by a duly licensed engineer or land surveyor of the State of New Jersey.

Any person who violates any of the provisions of this chapter shall, upon conviction thereof, be liable to the penalty stated in Chapter 1, Article II, General Penalty. The Township Engineer shall be responsible for the enforcement of this chapter.
