[HISTORY: Adopted by the City Council of the City of Glen Cove 10-22-1991 (Ch. 16, Art. XI, of the 1981 Code). Amendments noted where applicable.]
Bottled/vended water facilities consisting of either bottling plants or vending machines shall not be connected to the facilities of the City of Glen Cove as a new service of Glen Cove until a permit has been obtained from the city.
A. 
A permit shall not be issued unless said bottled/vended water facility:
(1) 
Has a separate outside water service with a separate meter.
(2) 
Has a Department of Health approved reduced pressure zone device.
(3) 
Has received approval or certification from the New York State Department of Health/Nassau County Health Department.
(4) 
Has provided and maintains an occurring $1,000,000 liability policy in form acceptable to the City of Glen Cove counsel, including general and product liability plus $2,000,000 aggregate liability policy plus $3,000,000 umbrella liability policy with the City of Glen Cove as the named insured.
(5) 
Has agreed under the permit to hold harmless and indemnify the city, from any and all claims for damages, including reasonable attorney fees, resulting from the dispensing of water from the facility or inspection and testing requirements herein.
B. 
The permit is also conditioned upon periodic inspection under the programs of both the United States Food and Drug Administration and the New York State Department of Health; and is further conditioned upon:
(1) 
Weekly testing on the end product by an independent New York State approved laboratory for bacteriological testing, with the test results being mailed directly by the laboratory to the City of Glen Cove and the regulatory agencies.
(2) 
Quarterly testing for 60 organics plus 10 heavy metals plus 23 physical/inorganic tests by an independent New York State approved laboratory for organic and heavy metal testing, with the test results being mailed directly by the laboratory to the city and the regulatory agencies.
(3) 
Annual testing for 11 pesticides plus two herbicides plus 128 EPA priority pollutants by an independent New York State approved laboratory for pesticide testing, with the test results being mailed directly by the laboratory to the City of Glen Cove and the regulatory agencies.
(4) 
Results of tests shown that the water meets the requirements of all governmental and regulatory agencies.
In the event that any of the above conditions are not met to the satisfaction of the city, the permit shall be revoked and water service to said bottled/vended water facility shall be terminated forthwith.
A permit shall be set forth from time to time by the Common Council.[2]
