The Board of Trustees of the Village of Patchogue finds that the conservation of recyclable materials is now a necessity in order to conserve natural resources, decrease the amount of solid waste, reduce the cost of solid waste disposal and extend the life of landfills where such disposal is made. It is the purpose of this legislation to institute a program of mandatory recycling for specific recyclable materials in an attempt to provide the maximum environmental and economic benefit with the minimum inconvenience to residents and property owners. Such a program is further designed to protect the health, safety and general welfare of the Village of Patchogue.
As used in this article, the following terms have the meanings indicated:
RECYCLABLES
Discarded materials which may be reclaimed, comprising solid waste in the form of newspapers, glass bottles and jars, metal cans, plastics, aluminum foil and foil products and corrugated cardboard, and which may be further defined as follows:

A. 
(1) 
Newspapers, clean and unsoiled shall include newspaper, Sunday magazines, advertising inserts and mailed advertising sheets on newspaper stock.
(2) 
Recyclable newspapers do not include magazines, junk mail, file folders, telephone books, advertisements, reports, paperback books, stationery, soiled newspaper, corrugated cardboard and cardboard.
B. 
(1) 
Glass bottles and jars shall include clear and colored bottles and jars.
(2) 
Recyclable bottles and jars do not include ceramics, window glass or safety glass.
C. 
(1) 
Metal cans shall include tin, aluminum and bimetallic cans.
(2) 
Recyclable metal cans do not include aerosol spray cans or cans contaminated with toxic chemicals, as that term may be defined in federal, state, county, Town or local laws, rules and regulations.
D. 
(1) 
PET plastic, including the clear plastic containers used for soda, some fruit juices, cooking oils, liquor bottles, peanut butter jars and other items.
(2) 
HDPE plastic, including the milky plastic containers used for plastic milk jugs, spring water jugs, cider containers and many bleach, detergent and oil containers.
E. 
(1) 
Aluminum foil and disposable aluminum foil products, such as pie plates, broiler pans, frozen food containers and take-out food containers.
F. 
(1) 
Cardboard. All corrugated cardboard normally used for packing, mailing, shipping of containerized goods, merchandise or other material, but shall not mean wax-coated or soiled cardboard.
A. 
Recyclables shall be separated from all other garbage or solid waste.
B. 
Recyclables shall be placed at the curbside on Wednesday mornings for collection. Recyclables shall not be placed in such a manner as to become a hazard or potential hazard to public travel, health or safety or to become a nuisance of any sort. Wednesday shall be the recycling day, except during holiday and snow emergency weeks when no recyclables will be collected. They shall be placed at curbside before 6:00 a.m.
C. 
Newspapers shall be placed in brown paper grocery bags or tied with twine. No plastic bags or plastic string shall be used for newspapers. Corrugated cardboard shall be broken down and tied in bundles. No plastic string or wire and no plastic or paper bags shall be used for corrugated cardboard. Corrugated cardboard shall be bundled separately from newspapers. Newspapers and corrugated cardboard are to be placed beside or on top of the red recycling container.

D. 
Glass bottles, jars, metal cans and plastic containers shall be empty, rinsed and clean. Labels, caps and lids need not be removed. Aluminum foil shall be rinsed and crumpled, and aluminum foil containers shall be rinsed. These recyclables are to be placed inside the red recycling container.

E. 
Recyclables shall not be placed in the same garbage can as or otherwise mixed with other forms of solid waste for collection, removal or disposal.
F. 
From the time of placement beside the curb, recyclable materials shall become the property of the Village of Patchogue. It shall be unlawful for anyone to collect, remove or dispose of recyclables which are the property of the Village without the consent of the Village Board.
G. 
Any resident may donate or sell recyclable materials to any person, partnership or corporation whether operating for profit or not for profit. However, said person, partnership or corporation may not pick up any recyclable materials from the curbside in the Village of Patchogue.
H. 
The Village Board shall be permitted, from time to time, to promulgate such rules or regulations as may be deemed necessary to effectuate the intent of this article.

A. 
A person convicted of violating any of the provisions of this chapter shall be subject to the penalties provided for in § 1-1 of the Code of the Village of Patchogue.
B. 
Failure to comply with the terms of this chapter on a subsequent recycling collection day shall be considered a separate offense.
