Except in the case of an emergency or in compliance with the directions of a peace officer or traffic control sign, the following shall govern the parking of vehicles on the public highways of the Town of New Castle.

No person shall park a motor vehicle without a current, valid registration properly displayed pursuant to the applicable laws and regulations of any state.

A. 
Handicapped parking. It shall be the responsibility of the Chief of Police of the Town of New Castle to designate parking spaces to be reserved for parking by handicapped persons only, whose vehicle shall display a handicapped permit. Parking shall be prohibited in any such space by vehicles not displaying a handicapped permit.
B. 
Police vehicle parking. It shall be the responsibility of the Chief of Police of the Town of New Castle to designate parking spaces to be reserved for parking any official police vehicles only. Parking shall be prohibited in any such spaces by vehicles other than official police vehicles.
C. 
Designation of reserved parking spaces. Any spaces designated by the Chief of Police under Subsections A and B shall be marked by appropriate signs.

A. 
Merchant and parking district resident parking permits, fees and eligibility.
(1) 
No vehicle shall be parked for a period in excess of three hours, except at meters, in any parking lot or parking area owned or controlled by the Town of New Castle or New Castle Parking District No. 1 (public parking lots), excluding the Town Hall, the areas defined in § 123-27A or B hereof and the area defined in § 123-9C hereof, which areas are the subject of separate regulations hereunder, except motor vehicles displaying a merchant parking or parking district resident permit, which may be parked for longer periods in designated areas within public parking lots, provided that vehicles bearing these merchant parking permits are being used by persons working at their places of employment within the New Castle Parking District.
(2) 
Such merchant parking permits shall be issued by the Town Clerk upon application, at a fee as set forth by resolution of the Town Board in the Master Fee Schedule, which may be amended. Such fee shall be prorated quarterly. Upon surrender of such permit, a refund shall be made for any remaining full-quarter period to the end of the fiscal year.
(3) 
Owners of businesses located within the New Castle Parking District No. 1 who employ persons on a regular basis, full time or part time, and such employees may apply for merchant parking permits. Merchant parking permits purchased by such owners may be used by owners' regular full-time and part-time employees. The maximum number of merchant parking permits which may be issued to such owners shall be determined by resolution of the Town Board from time to time. Such owners and persons so employed in businesses located outside the district but within the B-RP Zoning District may also apply for such parking permit, provided that a parking easement on that property has been granted to the Town or to the parking district, and provided that the owner of such property has paid a fee as set forth by resolution of the Town Board in the Master Fee Schedule, which may be amended.
(4) 
Owners of buildings within New Castle Parking District No. 1, which house residences may apply for parking district resident permits. The maximum number of parking district resident permits which may be issued to such owners shall be determined by resolution of the Town Board from time to time. Such owners and persons living in such buildings outside the district but within the B-RP Zoning District may also apply for such parking district resident permits, provided that a parking easement on that property has been granted to the Town or to the parking district, and provided that the owner of such property has paid a fee as set forth by resolution of the Town Board in the Master Fee Schedule, which may be amended. Parking district resident permit holders shall follow all parking signs for merchant permit parking.
B. 
The areas to be designated for parking with a merchant parking permit/parking district resident permit shall be determined by the Town Supervisor with the advice of the Chief of Police and approved by resolution of the Town Board. The merchant parking permit/parking district resident permit cannot be transferred and shall list the license plate numbers of vehicles for which it is a valid permit. The permit is to be displayed in a plastic holder provided by the Town or clearly visible on the vehicle dashboard. Metered parking in public parking lots shall be enforced during weekdays, except holidays, between the hours of 6:00 a.m. and 6:00 p.m. Other parking limitations in public parking lots shall be enforced on weekdays, except holidays, between the hours of 6:00 a.m. and 6:00 p.m. and on Saturdays between the hours of 8:00 a.m. and 1:00 p.m.
C. 
Parking in the following described area shall be restricted to fifteen-minute parking, and three-hour parking limitations or, for parking with a merchant parking permit/parking district resident permit, as designated by the Chief of Police in consultation with the Town Supervisor and approved by resolution of the Town Board, which restrictions shall become effective upon posting of appropriate signs at the front of each restricted parking area:
All that certain plot, piece or parcel of land situate, lying and being in the Town of New Castle, County of Westchester and State of New York, being bounded and described as follows:
Beginning at a point in the northerly side of Woodburn Avenue, said point being distant north 68° 58 26 west 96.00 feet from the intersection of the westerly side of South Greeley Avenue with the northerly side of Woodburn Avenue; thence north 21° 01 34 east 150.00 feet along the lands of the Town of New Castle to a point; thence south 68° 58 26 east 57.32 feet to the westerly side of the overpass; thence southerly along the westerly side of the overpass on a curve to the right having a radius of 173 feet and an arc length of 51.24 feet to the westerly side of South Greeley Avenue; thence north 68° 58 26 west 61.21 feet; thence south 21° 01 34 west 106.0 feet to the northerly side of Woodburn Avenue; thence north 68° 58 26 west 22.0 feet along the northerly side of Woodburn Avenue to the point or place of beginning.
D. 
Overnight parking exceeding 48 hours from November 1 through April 1 is only permitted in metered and commuter-permit-required parking lots in designated overnight parking areas.

No vehicle shall be parked, stored or left standing unattended by a person capable of operating it on any street or highway at any time between the hours of 1:00 a.m. and 7:00 a.m. during the period between the first day of November and the first day of April. The provisions of this section shall not apply to the parking of an ambulance nor to a vehicle operated by a physician or surgeon on a professional call.

No commercial vehicle, other than a station wagon, shall be parked on any street between the hours of 9:00 p.m. and 6:00 a.m. other than for the expeditious unloading or loading of materials.

The Town Board hereby creates and establishes the office of Parking Enforcement Officer. Such position shall be filled by appointment of the Town Board upon recommendation of the Chief of Police. The term of office shall be at the pleasure of the Town Board.
B. 
The Parking Enforcement Officer and Dog Control Officer are hereby authorized and empowered to take all steps necessary in order to fully administer and enforce all statutes, ordinances, rules and regulations relating to parking as contained in Chapter 123 of the Code of the Town of New Castle and the Vehicle and Traffic Law and as otherwise provided by law. The Parking Enforcement Officer and Dog Control Officer are hereby expressly authorized to issue appearance tickets in connection with violations of the statutes, ordinances, rules and regulations to be enforced by such officers and shall have such other powers, duties and responsibilities as may be delegated to said officers by the Town Board upon recommendation of the Chief of Police.

A. 
Any person violating any provision of this article relating to parking of a motor vehicle shall be guilty of a traffic infraction and shall, for a first conviction thereof, be punished by a fine of $30.
B. 
Any person violating any provision of this article relating to parking of a motor vehicle in a parking space reserved for parking by handicapped persons shall be guilty of a traffic infraction and shall, for a first conviction thereof, be punished by a fine of $150, and for a second or subsequent offense within 18 months after the first conviction, such person shall be punished by a fine of $200.
C. 
Any violation of § 123-4.1 or § 123-4.2 of this article relating to unregistered or uninspected motor vehicles with a registration or inspection which has been expired for less than 60 days shall be punished.by a fine of $30. Any motor vehicle in violation of § 123-4.1 or 123-4.2 whose registration or inspection has been expired for 60 to 90 days shall be punished by a fine of $60. Any motor vehicle in violation of § 123-4.1 or § 123-4.2, whose registration has been expired for 90 days or more, shall be punished by a fine of $90.
D. 
Any fine imposed pursuant to this § 123-11 which remains unpaid for a period exceeding 30 days from the date of issuance of a summons, or, in the case of pretrial or pretrial conference, after conviction, shall be increased to twice the amount of the original fine imposed. Any fine which remains unpaid for a period exceeding 60 days after the date of issuance of the summons, or, in the case of a trial or pretrial conference, after conviction, shall be increased to triple the amount of the original fine imposed.
E. 
There shall be a rebuttable presumption that the owner of a vehicle was the operator of such vehicle at the time of the issuance of a summons for a violation in connection with any provision of this article relating to parking of a motor vehicle. This presumption may be rebutted by credible evidence that the owner was not in possession or control of the vehicle at the time it was parked.
