The Board of Trustees of the Village of Great Neck Plaza finds that, in order to enable the village to plan properly for its future parking needs, in order to be able to respond adequately in fire and police emergency situations, in order to maximize the free flow of traffic on village streets and in order to aid in the prevention of certain crimes, certain information must be available to the village about the users of long-term daytime parking on local streets. For the purpose of obtaining such information, the village hereby adopts this article to establish a parking permit program that will exempt the holder of such permit, after issuance of the sticker, from certain time limitations on parking which apply to streets within the village.
All definitions found in the Vehicle and Traffic Law of the State of New York shall apply to this article, with the following exceptions:
APPLICANT
The individual who is applying for a parking permit.
COMMERCIAL VEHICLES
Include trucks, buses, vans, any other vehicle used for commercial purposes or any other vehicle to be so designated by the Village Clerk.
CLERK
The Clerk of the Village of Great Neck Plaza or the designee of such Clerk.
GENERAL PARKING TIME LIMITATIONS
Only those limitations imposed on parking on streets within the village by posted signs bearing the designation "2- or 3-hour parking, Monday - Friday, 10:00 a.m. - 4:00 p.m."
PARKING STICKER
A nontransferable sticker issued by the Clerk to be conspicuously affixed to the left side of the rear bumper of the vehicle.
VEHICLE
Every device in, upon or by which any person whose property is or may be transported or drawn upon a highway.
A. 
The Clerk is hereby authorized to issue biyearly parking stickers to any applicant who pays the requisite fee, provides the information requested on the application form and meets all other requirements of the Article, except that no parking sticker shall be applied for, issued or used with respect to a commercial.
B. 
The Clerk shall have the power to adopt rules and regulations to implement the provisions of this Article.
Any authorized vehicle displaying a parking sticker in the manner described in § 151-25E shall be exempt from the general parking time limitations posted on the unmetered curbsides of the streets of the village.
A. 
Application. Any person wishing to obtain a parking sticker shall do so by filing an application form with the Clerk. The application form shall contain such information as the Clerk deems necessary for the just and efficient implementation of the purposes of this Article, including at least the following information: the applicant's home address and telephone number, the applicant's business address and telephone number, if any, and the reason why the applicant requires long-term daytime parking within the village. The Village Clerk shall set the days and hours during which such applications will be accepted.
B. 
Proof of possession; nontransferability. Any applicant wishing to obtain a parking sticker shall submit proof that the applicant owns or leases the vehicle for which the sticker is sought, as well as a valid driver's license. Each parking sticker issued by the Clerk shall display the years for which it has been issued and the license plate number of the vehicle for which it was issued. Such parking sticker shall be nontransferable, and a new sticker must be obtained in the event of a change of vehicle or a change of license plate.
C. 
A parking permit may be issued to person for a motor vehicle not registered in his or her name if such person has actual use and custody of the motor vehicle and if the motor vehicle is owned or leased by a corporation or business firm employing the person.
D. 
No such parking sticker shall be applied for, issued or used with respect to a commercial vehicle or shall be issued to an applicant who has outstanding parking violations.
E. 
Placement. All permits must be applied to the rear bumper of the left side of the vehicle. Old permits must be removed before new ones are applied.
F. 
Fees. Each application for a parking permit under this article shall be accompanied by a fee of $5, which shall be nonrefundable. Said fee may hereinafter be increased up to $10 by resolution of the Board of Trustees. Said fee shall be waived if, at the time a parking permit is applied for, the applicant provides proof that the motor vehicle for which the permit is to be issued either:

(1) 
Is classified as a "hybrid" vehicle by the United States Environmental Protection Agency (EPA) or by the United States Department of Energy (DOE); or
(2) 
Has an EPA or DOE fuel efficiency rating for city driving in excess of 30 miles per gallon.
G. 
Period of effectiveness.
(1) 
Each parking sticker shall expire on December 31 of the second (later) year indicated on the parking sticker. However, the permit will remain valid for three months after the expiration so as to enable the Village Clerk to reissue permits and to allow the applicants sufficient time to reapply for the same.
(2) 
Whenever any condition necessary for the issuance of a parking sticker ceases to exist, such parking sticker shall be null and void, and any privileges accruing thereto shall be revoked.
(3) 
Whenever any parking sticker is defaced, mutilated or in any way altered, such parking sticker shall be null and void, and any privileges accruing thereto shall be revoked. An applicant with a parking sticker that is defaced, mutilated or in any way altered may apply without fee or penalty to the Village Clerk for a replacement thereof.
A. 
The Village Clerk may cancel a permit or sticker issued hereunder if she finds that there was a misstatement of some material fact in the application for the permit.
B. 
A permit issued hereunder shall be automatically canceled upon the happening of any one of the following events:
(1) 
The permit is displayed on a vehicle other than the one for which it was issued, is altered in any way, is illegible or is incorrectly displayed on a vehicle.
(2) 
The motor vehicle for which the permit is issued is sold or transferred.
C. 
Where a permit is canceled, the Village Clerk may demand the return of said permit or may affix to the permit a sticker bearing the legend "VOID" or "CANCELED."

Any person who falsifies a parking sticker, who improperly transfers a validly issued parking sticker or who otherwise violates this Article shall pay a penalty not to exceed $250, for each such violation, in addition to any other penalties provided by law.
The Village of Great Neck Plaza hereby repeals Local Law Nos. 3 and 7 of 1987, except that any parking sticker issued under either of such local laws shall be deemed valid until April 15, 1989.
