As used in this chapter, the following terms shall have the meanings indicated:
PUBLIC PROPERTY
All real property, including improvements owned or leased by the City, except streets and sidewalks.
PUBLIC WAYS
All streets and sidewalks owned or maintained by the City.

A. 
No person shall, on public property where posted, consume alcohol, possess alcohol in an open container, remain on the site after hours or swim, crab or fish from or near structures upon or affixed to such public property.
B. 
No person shall urinate or defecate on or about any public property, any public way or any open area in which such conduct is visible, including, without limitation, parking lots, shopping centers and commercial properties.
No person shall consume alcoholic beverages on any public way of the City.

A. 
A violation of § 89-2A shall be a municipal infraction punishable by a fine of $100 for a first offense.
B. 
A violation of § 89-2B shall be a misdemeanor subject to a fine of not more than $500 or to imprisonment for not more than 30 days or to both.
