As used in this chapter, the following terms
shall have the meanings indicated:
Any receptacle used or maintained by any person for the collection
or storage of litter. This includes commercial, industrial or construction
receptacles.
A.
No dumpster shall be kept, maintained, used or operated
on a Village street or Village property unless the owner or user thereof
shall first obtain a license from the Village Clerk of the Village
of Irvington.
B.
A license shall be issued upon the following terms
and conditions:
(1)
An application shall be made by such person to the
Village Clerk for said license upon forms to be furnished by said
Clerk.
(2)
Said license shall allow the owner or user of the
dumpster to keep or maintain a dumpster on a Village street for a
period of time not to exceed five consecutive days. Said license may
not be renewed.
(3)
A cash bond in the sum of $300 shall be required.
(4)
A license fee in the sum to be established and determined by the Board of Trustees from time to time and set forth in the appendix herein shall be required. (See Chapter 114 of the Village Code.)
(5)
Before any permit shall be granted, the applicant
shall provide and deposit with the Clerk a public liability insurance
policy in the amount of $1,000,000, single limit, naming the applicant
and Village of Irvington as co-insured.
C.
Said application shall give the name, phone number
and address of the applicant, the location by street and number where
the dumpster will be located, the number of days the dumpster will
be located on a Village street and such further information as the
Village Clerk or the Board of Trustees may require.
No person shall keep, maintain, use or operate a dumpster on a Village street for more than five consecutive days, as provided in § 106-2B(2) aforesaid, and in the event that a dumpster is located on a Village street for more than five days, he shall forfeit the cash bond provided for in § 106-2B(3) at the rate of $75 per day, in addition to the statutory penalties prescribed herein.
