As used in this chapter, the following terms shall have the meanings indicated:
FIREARM
Any pistol, revolver, rifle, shotgun, air gun, slingshot or bow and arrow which discharges a bullet, cartridge, shell shot, arrow, bolt or other missile propelled by the burning or explosion of gunpowder, by high pressure from pumping or other means, by spring which is set by a cocking operation or by the application and release of tension or pressure to a bow spring or string attached to such weapon or instrument and other items as defined by New York State Penal Law § 265.00
FIREWORKS
Any blank cartridge, blank cartridge pistol or toy cannon in which explosives are used, firecrackers, torpedoes, skyrockets, Roman candles, bombs or other combustible or explosive of like inflammable compound and other substances as defined by New York State Penal Law § 270.00, Subdivision 1.
No person, partnership or corporation shall sell or expose for sale within the boundaries of the Village of Irvington any fireworks, cannon, gun, pistol or other device used for the discharge of fireworks as defined in this chapter.
No fireworks shall be discharged within the boundaries of the Village of Irvington at any time, except under the written permit or license of the Board of Trustees, such permit or license to be issued by the Village Clerk with the approval of the Police and Fire Chief and when duly authorized by the Board of Trustees.
A. 
No person shall, except in self defense and when reasonably necessary for the protection of life and property, fire or discharge or cause to be fired or discharged any projectiles firing ammunition from any firearm, as defined in this chapter, within the boundaries of the Village of Irvington.
B. 
Exceptions.
(1) 
The prohibitions in this chapter shall not apply to any officer of the law while engaged in the protection of the safety of the people within the Village of Irvington.
(2) 
This section shall not prohibit the discharge of firearms at appropriate occasions of public ceremony, such as but not limited to theatrical performances, athletic events, parades and military ceremonies, where permission to do so has been applied for in writing and granted by the Chief of Police.
Violation of this chapter shall be punishable by a fine not to exceed $250.
This chapter shall be effective on and after June 21, 1993.
