The purpose of VP Districts is to protect and preserve the character of the community, to preserve and enhance property values and to promote improved visual relationships between the Village of Irvington, the Hudson River, and the Palisades.
Subject to the provisions of § 224-151 below, the permitted principal and accessory uses for any lot or parcel in a VP District shall be the same as otherwise permitted in the district in which the lot or parcel is located.
A.
No building or structure shall be erected, altered, enlarged or moved in the district unless approved in accordance with the provisions of this section.
B.
Every application to permit the erection or exterior alteration of a building or structure in a VP District shall be referred by the Building Inspector to the Planning Board for its review under the provisions of Chapter 224, Article XIV, Site Development Plan Approval. The Planning Board shall also review the proposal in a VP District as to the best siting, dimensions and configuration of principal and accessory structures so as to cause the least possible obstruction of the view of the Hudson River for neighboring properties and adjacent public property and rights-of-way.
[Amended 9-15-2003 by L.L. No. 21-2003]
C.
The Planning Board, during its site development review of a proposed erection or exterior alteration of a building or structure in the VP District, may refer the application to the Board of Architectural Review for comments prior to issuance of decision to approve or deny an application. This referral shall not limit any other powers granted to the Board of Architectural Review under the Village Code.
[Amended 9-15-2003 by L.L. No. 21-2003]
D.
In the Waterfront District, the Planning Board, in considering View Preservation approval, shall take into consideration the view of the Hudson River from Main Street and from Matthiessen Park and Scenic Hudson Park, in addition to the view from other neighboring properties and adjacent public property and rights-of-way.
