Calculations for significant noncompliance must be completed
for the two criteria which are evaluated on a six-month time frame.
These criteria, listed in 40 CFR 403.8(f)(2)(vii)(A) and (B), are
chronic violations and technical review criteria violations.

Calculations for this determination are based on LASA's "pretreatment
year," which is equal to the calendar year (January 1 to December
31).

Compliance determinations are made at the end of each quarter (March
30, June 30, September 30, and December 31).

Each evaluation uses data from the previous six months. This six-month
time period is known as a "rolling quarter."
D.Â
All data collected and analyzed in accordance with 40 CFR 136 shall
be used when determining the significant noncompliance status of the
industrial user.
The Authority shall publish annually, in a daily newspaper of
general circulation published in the municipalities served by the
Authority, a list of the users, which, during the previous 12 months,
were in significant noncompliance with applicable pretreatment standards
and requirements.
