The Selectmen and their successors in office are hereby empowered and instructed to expend the sum of $150 annually for the care and decoration of the Field Park in this Town as per the will of David Dudley Field.

The purpose of this article is to establish a Recreation Authority, pursuant to C.G.S. §§ 7-130a through 7-130w, inclusive, to sponsor, administer, and conduct recreational programs and activities for the benefit of the Towns of Haddam and Killingworth, jointly.
There is hereby established a joint municipal authority to be known as the "Haddam-Killingworth Recreation Authority" (hereinafter referred to as the "Authority").
A. 
Commission. The Authority shall be governed by a Commission composed of seven Commissioners. Initially four such Commissioners shall be appointed by the Town of Haddam and three such Commissioners shall be appointed by the Town of Killingworth.
B. 
Qualification. Each Commissioner shall be an elector of the town which appointed such Commissioner and shall be a member of the Park and Recreation Commission or similar body of that town.
C. 
Initial appointments and terms. The initial Commissioners shall be appointed by the Town Meeting of each respective town and for terms commencing with said appointment and ending June 30, 1992.
D. 
Subsequent appointment and term. Upon the expiration of the initial terms hereunder, each Commissioner shall be appointed to serve for a term of one year, commencing on the first day of July. Each Commissioner shall serve until such Commissioner’s successor has been duly appointed and qualified. Each Commissioner shall be selected by the Board of Selectmen and appointed by the Town Meeting of the appointing town.
E. 
Vacancies. The town with power to appoint a Commissioner shall fill any vacancy for the unexpired portion of the term of such Commissioner without undue delay. The failure of any person appointed to serve as a Commissioner to accept or assume such office shall constitute a vacancy.
F. 
Resignation. Any Commissioner may resign such office at any time by giving written notice of resignation to the Town Clerk of the town from which such Commissioner was appointed and to the Authority. Such resignation shall take effect at the time specified, at the time of receipt thereof. An acceptance of such resignation shall not be necessary to make it effective.
G. 
Principal office. Until changed by a duly adopted resolution of the Authority, the principal office of the Authority shall be located at:

H. 
Reapportionment. Each year prior to the appointment of Commissioners hereunder, the membership of the Commission shall be apportioned between the two towns based upon the average daily membership in Regional School District #17 established as of the preceding May 1.
A. 
General powers. Consistent with the purposes set forth herein, the Authority shall have the following powers as authorized in C.G.S. § 7-130d:
(1) 
To provide, sponsor, administer, conduct, regulate, acquire, own and maintain public recreational facilities, programs and activities for the joint use, enjoyment and benefit of the Towns of Haddam and Killingworth;
(2) 
To fix and make reasonable charge for the use of facilities established and maintained hereunder and for participation in programs and activities sponsored, administered or conducted hereunder;
(3) 
To expend funds as appropriated for its use by the Towns of Haddam and Killingworth; and
(4) 
To make contracts and agreements, including the power to employ a Director and such other agents and employees as the Authority may deem necessary and appropriate to carry out its purposes.
B. 
No bonding power. The Authority is specifically precluded from issuing bonds or any other evidence of indebtedness or from incurring any indebtedness other than short-term accounts payable in the ordinary course of business.
C. 
Real estate. The Authority may make no real property acquisitions or disposition in any form, including gifts, except short-term leases, without the approval of both participating towns.
D. 
Authority subject to land use regulation. The activities of the Authority in one or the other town shall be subject to the rules and regulations of the Planning and Zoning Commission or any other land use regulatory authority of such town in the same manner as any other person undertaking land use in said town.
E. 
Budget. The Commission shall be responsible for the preparation of an annual budget and shall determine each town’s share of such budget based upon Regional School District #17 average daily membership. Each of said towns shall include such assessment as an appropriation for such purpose in its annual operating budget, subject to the approval of the Boards of Selectmen and the Boards of Finance of Haddam and of Killingworth.
(1) 
The budget approved by the Authority shall be presented to the respective Haddam and Killingworth Boards of Selectmen and Boards of Finance at times set by each such Board.
(2) 
A representative of the Authority will be present at each of the public hearings and annual budget meetings held in each town.
(3) 
Each town’s share of the budget shall be determined based upon actual average daily membership figures established by the Regional School District #17 Board of Education after May 1.
(4) 
If the Board of Selectmen or the Board of Finance of either town, or the Haddam or Killingworth Annual Budget Meeting, reduces the funds budgeted for the Authority, a proportional reduction shall be made by the other town.
F. 
Records and reports. The Authority shall maintain accurate records of receipts and expenditures and records of the conduct of its affairs and shall submit to each town’s Board of Selectmen an annual report of the Authority’s activities during the preceding year. The Authority shall also submit such reports, at such time or times, as either of said Boards may prescribe.
The Commission shall elect, from among its members, a Chairman and a Vice-Chairman, and shall also elect a Secretary, a Treasurer, and such other officers as it may deem necessary or appropriate, who need not be members of the Commission. The Commission shall adopt bylaws, not inconsistent with this chapter or state statutes, governing the conduct of its meetings and business.
Following adoption by the Town Meetings of both towns or by the Town Meeting last to adopt the same, this chapter shall become effective 15 days after publication thereof in a newspaper or newspapers having a circulation in each town.
