The provisions of these regulations shall relate to the construction, alteration and maintenance of buildings and other structures within the limits of the Town of Plainville, County of Norfolk, except such as are owned and occupied by the Commonwealth of Massachusetts or by any county, and also excepting bridges, quays and wharves. Its provisions are intended to be carried out in a manner as will best promote the health, safety, convenience and welfare of the inhabitants and lessen the danger from fire.
No building, structure or part thereof shall hereafter be constructed except in conformity with the statutes of the commonwealth and these bylaws, and no building already erected or hereafter built shall be raised or built up in such a manner that, were such building wholly built or constructed after passage of these bylaws, it would be in violation of any provisions thereof, and no building or structure shall be moved to any location where its construction would be in violation of the provisions of statutes of the commonwealth or these bylaws. Any alteration, addition to or reconstruction of any existing building or structure already erected or hereafter built shall, to the extent of such work, be subject to the provisions of these bylaws.
A. 
If any section or paragraph or provision or portion thereof contained in these bylaws is invalid, the validity of the remainder shall not be affected thereby.
B. 
If any provision herein or the application of such provision to any person or circumstance shall be held invalid, the validity of the remainder of this set of bylaws and applicability of such provisions to other persons or circumstances shall not be affected thereby.
These bylaws may be altered, repealed or amended by a two-thirds vote at any Annual Town Meeting, at any other Town Meeting specially called for the purpose; an article or articles for such purpose having been inserted in the Warrant for such meeting.
The Board of Selectmen of the Town of Plainville shall employ and designate an Inspector of Buildings or Building Commissioner (hereinafter "Inspector of Buildings") as well as such other local inspectors as are reasonably necessary to assist the Inspector of Buildings to administer and enforce the State Building Code and the rules and regulations made under the authority thereof. The Inspector of Buildings shall report directly to and be solely responsible to the appointing authority.
The Inspector of Buildings and local inspector (hereinafter "Building Official") shall enforce all of the provisions of 780 CMR, 521 CMR (Architectural Access Board) and any other state statutes, rules and regulations or ordinances or bylaws which empower the Building Official. The Building Official shall act on any question relative to the mode or manner of construction and materials to be used in the construction, reconstruction, alterations, repairs, demolition, removal, installation of equipment and the location, use, occupancy and maintenance of all buildings and structures, except as otherwise specifically provided for by statutory requirements or as provided for in 780 CMR 109.0.
A. 
Permit application for new construction of houses, factories, warehouses or retail structures and professional buildings shall be in accordance with the Town of Plainville Zoning Bylaw, §§ 500-3 through 500-6, and must be accompanied by the following prior to permit issuance:
(1) 
Topo map.
(2) 
Plot plan.
(3) 
Perc test.
(4) 
Water test (well area).
(5) 
Approved signature (Fire Chief).
(6) 
Blueprints (three complete sets).
B. 
Permit application for additions or alterations to an existing structure shall be in accordance with the Town of Plainville Zoning Bylaw, §§ 500-3 through 500-6, and must be accompanied by the following prior to permit issuance:
(1) 
A plot plan, where external alterations are planned.
(2) 
A perc test, where expansion of sanitary facilities is involved.
(3) 
A water test, where expansion of water supply is involved.
(4) 
Approved signature (Fire Chief).
(5) 
Three sets blueprints or diagram.
C. 
Permit application for separate structures not intended for human or animal habitation shall be in accordance with the Town of Plainville Zoning Bylaw, §§ 500-3 through 500-6, and must be accompanied by the following prior to permit issuance:
(1) 
Structures over nine feet by 10 feet in size:
(a) 
A plot plan.
(b) 
Three sets of blueprints or diagram.
D. 
Permit application for separate structures intended primarily for animal habitation shall be in accordance with the Town of Plainville Zoning Bylaw, §§ 500-3 through 500-6, and must be accompanied by the following prior to permit issuance:
(1) 
Structures over nine feet by 10 feet in size:
(a) 
A plot plan.
(b) 
Approved signature (Fire Chief).
(c) 
Three sets of blueprints or diagram, and such additional documents as needed to show adequate control of animal waste.
All permits shall be void if operations thereunder are not commenced within 90 days after the date of permit or if the operations thereunder are discontinued for a period of more than six months; subject, however, to strikes and delays of materials. A notice of permits granted by the Inspector of Buildings shall be posted forthwith by the owner of the premises.
A. 
If no other penalty for violations is provided, whoever violates any of the provisions of these regulations shall be liable to a fine not to exceed $300.
B. 
Violations of this bylaw may be enforced via the noncriminal disposition provisions set forth in Chapter 277, Article II, of the Code of the Town of Plainville; in which case, the penalty for any such violation shall be $50. The enforcing person(s) shall be the Inspector of Buildings.
A. 
A fee for each plan examination, building permit and inspection shall be paid in accordance with the Fee Schedule as established by the Board of Selectmen.
B. 
The payment of the fee for the construction, alteration, removal or demolition for the work done in connection with or concurrently with the work authorized by a building permit shall not relieve the applicant or holder of the permit from the payment of other fees that are prescribed by law.
C. 
The Fee Schedule will be available on the Town website.
