GENERAL REFERENCES

A. 
It shall be the duty of any owner or tenant or person in possession of any lands in the Township:
(1) 
To keep such lands free of brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris, where the same are inimical to the preservation of public health, safety or general welfare of the Township, or which may constitute a fire hazard.
(2) 
Where the lands abut or border upon any public street in the Township, to remove all grass, weeds, brush and other debris from that part of the street bordering on their respective lands.
B. 
Time limit for placement.

(1) 
No owner, tenant or person in possession of such lands shall place or allow to be placed along the curbline of or in the street or roadway abutting such lands any brush, weeds, trees (up to four inches in diameter), stumps, or obnoxious growths no earlier than seven days prior to the scheduled pickup and disposal of such items, whether such pickup and disposal be by the Township or otherwise. Until no earlier than seven days prior to the scheduled pickup and disposal of such items, the owner, tenant or person in possession of such lands shall keep such items in a suitable and safe place on such lands so as to not create a nuisance, dangerous condition or health hazard.
(2) 
Disposal of leaves. No owner, tenant or person in possession of such lands shall place or allow to be placed along the curbline of or in the street or roadway abutting such lands any unbagged leaves. Leaves shall be bagged in the biodegradable leaf bags provided by the Township. Pickup and disposal of such items will be in accordance with Subsection B(1) above.
Whenever the public officer charged with the enforcement of this chapter shall deem it necessary and expedient for the preservation of the public health, safety and general welfare or the elimination of a fire hazard or upon the investigation of a complaint of any resident, officer or employee of the Township, he or she may order the owner, tenant or person in possession of any lands on which any grass, weeds, trash or other debris are found to exist, to remove the same within 10 days.
A. 
The public officer shall make such order in writing and serve the same, either personally or by registered mail, upon the tenants or person in possession of the affected lands.
B. 
A copy of the order shall be filed with the Township Clerk.
C. 
The public officer shall reinspect the lands in question after the ten-day period shall have expired and determine whether or not the condition complained of has been abated or remedied.
No person shall throw, deposit or cause to be thrown or deposited any brush, weeds, dead and dying trees, stumps, roots, obnoxious growth, filth, garbage, trash or debris of any kind, or permit the same to be scattered by wind or otherwise, upon lands of another person.

A. 
Commercial landscapers may not operate within the Township of Hazlet without first procuring a license to be issued by the Licensing Agent. The license period shall be for one year, from July 1 through June 30, and be issued upon payment of a license fee of $35. The license application shall include the name, address and telephone number of the commercial landscaper together with the name, address and telephone number of the principals of such enterprise, vehicle descriptions, and shall indicate whether the applicant is incorporated, a partnership, or individual proprietorship. The license is to be displayed on the front driver's side bumper.
(1) 
There shall be no restrictions on the number of such licenses issued.
(2) 
Commercial landscapers must be thus licensed to perform any commercial landscaping services within the Township of Hazlet.
B. 
Commercial landscapers working within the Township of Hazlet shall be responsible for disposal of all brush and tree cuttings generated, and shall not place any brush and tree cuttings along the street or for curbside collection.

C. 
No brush or tree cuttings shall be placed, stored or otherwise disposed of on any public property, within ponds, lakes, streams, swamps, marshes, wetlands, wetland buffers, conservation easements, nontidal floodways, or similar watercourses.

D. 
Commercial landscapers shall not dispose of leaves or grass into roadways or storm sewers and must dispose of same at an appropriate off-site disposal area.

E. 
The disposal of brush, leaves or grass for commercial landscapers will not be accepted at the Hazlet Township Recycling Department Facility.

A. 
Whenever it shall appear necessary and expedient for the preservation of the public safety to cut all brush, hedges and other plant life, growing within 10 feet of any roadway and within 25 feet of the intersection of two roadways, to a height of not more than 2 1/2 feet, the officer, hereinafter named, shall cause notice thereof to be given to the owner or tenant of the lands and the owner or tenant of the lands, within 10 days after notice thereof, shall cut the brush, hedges and other plant life to a height of not more than 2 1/2 feet.
B. 
In case the owner or tenant of the lands shall refuse or neglect to cut the brush, hedges and other plant life to a height of not more than 2 1/2 feet within 10 days after notice thereof, the same shall be cut by or under the direction of the Construction Code Official or such other officer of the Township as the Township Committee may designate from time to time, provided that lands do not abut county roads and are not at any intersections with county roads. In case the lands are upon county roads or at intersections with county roads, then the brush, hedges and other plant life shall be cut by or under the direction of the County of Monmouth or such other officer as the County of Monmouth may designate from time to time.
C. 
Owners or tenants of lands abutting county roads or at intersection with county roads shall be notified of a violation of this section by the County of Monmouth. All other owners or tenants of land shall be notified of a violation of this section by the Construction Code Official of the Township or such other officer of the Township as the Township Committee may designate from time to time.
A. 
In the event that the owner, tenant or person in possession of the lands in question shall refuse or neglect to abate or remedy the condition complained of within 10 days after receipt of notice, the public officer shall cause the condition complained of to be abated and remedied and shall certify the cost thereof to the Township Committee, which shall examine the certificate and, if found correct, cause the cost as shown thereon to be charged against the lands.
B. 
The amount so charged shall forthwith become a lien upon such lands and shall be added to and become and form a part of the taxes next to be assessed and levied upon such lands, the same to bear interest at the same rate as taxes, and shall be collected and enforced by the same officer and in the same manner as taxes.
C. 
Costs shall be in addition to any penalties imposed for any violation of this chapter.

For violation of any provision of this chapter, the maximum penalty, upon conviction, shall not exceed the maximum penalties set forth in Chapter 1, General Provisions, Article III. Each and every violation of any provision of this chapter shall be considered a separate violation and shall subject the person so charged to the maximum penalty.
