Pursuant to the Uniform Fire Safety Act (P.L. 1983, c. 383; N.J.S.A. 52:27D-192 et seq.), the New Jersey Uniform Fire Code (N.J.A.C. 5:70) shall be enforced locally within the Township of Hazlet by promoting the control of fire hazards; regulating the installation, use and maintenance of equipment and the use and occupancy of structures, premises and open areas; providing for the abatement of fire hazards; and establishing and implementing standards to achieve said objectives. In the event of any conflict between the provisions of this article and those set forth in said code, the provisions hereof shall govern. Said standards, rules and regulations set forth in said code shall be and the same are hereby incorporated in this article by reference, three copies of which are on file in the office of the Township Clerk.

The local enforcing agency shall be the Bureau of Fire Prevention for Fire District No. 1 in the Township of Hazlet, County of Monmouth, hereinafter referenced as "Bureau."

A. 
The Bureau shall enforce the Uniform Fire Safety Act (N.J.S.A. 52:27D-192 et seq.) and the codes and regulations adopted pursuant thereto in all buildings, structures and premises within the Township of Hazlet, other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code (N.J.A.C. 5:70).
B. 
The Bureau of Fire Prevention, in addition to the duties assigned heretofore, shall enforce within the Township of Hazlet the BOCA Fire Prevention Code provisions not incorporated within the Uniform Fire Code (N.J.A.C. 5:70).

The local enforcing agency established by § 214-2 of this chapter shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code (N.J.A.C. 5:70) on behalf of the Commissioner of Community Affairs.

Such funds as may be necessary to support the operations of the local enforcing agency shall be raised by the Bureau in the manner provided by law.

A. 
Appointment of fire official. The Bureau shall appoint the fire official who shall serve as the chief administrative and inspection official for said agency.
B. 
Term of office. The fire official shall serve at the pleasure of the Bureau.
C. 
Inspectors and employees. The Bureau shall appoint such other inspectors and other employees as are deemed necessary.
D. 
Removal from office. The fire official, inspectors and other employees of the Bureau shall be subject to removal by the Bureau for inefficiency or misconduct, but each person so removed shall be afforded an opportunity to be heard by the Bureau consistent with recognized standards of due process.
Pursuant to Section 15 and 17 of the Uniform Fire Safety Act (N.J.S.A. 52:27D-206 and 52:27D-208), any person aggrieved by any order of the local enforcement agency shall have the right to appeal to the County Construction Board of Appeals of the County of Monmouth.

In addition to the inspection and fees required pursuant to the Act and the regulations of the Department of Community Affairs,[1] the following additional inspections and fees for those uses not defined as life hazard uses shall be required:
A. 
The following buildings, uses and premises contained in this section other than those that are incidental or auxiliary to the agricultural use of farm property are subject to registration and periodic inspection requirements as hereby established.
B. 
Where two or more of the same use or different uses exist at the same building or premises, each one shall be considered as separate and distinct for the purpose of this article and shall be registered pursuant thereto.
C. 
Type M uses:
(1) 
Business uses as defined in the latest edition of the BOCA Basic National Building Code, less than 2,500 square feet total gross floor area.
(2) 
Mercantile uses as defined in the latest edition of the BOCA Basic National Building Code, less than 2,500 square feet total gross floor area.

(3) 
Storage buildings as defined in the latest edition of the BOCA Basic National Building Code, less than 2,500 square feet total gross floor area.
D. 
Type N uses:
(1) 
Business uses as defined in the latest edition of the BOCA Basic National Building Code, 2,500 square feet or more, but less than 5,000 square feet total gross floor area.
(2) 
Mercantile uses as defined in the latest edition of the BOCA Basic National Building Code, 2,500 square feet or more, but less than 5,000 square feet total gross floor area.
(3) 
Storage buildings as defined in the latest edition of the BOCA Basic National Building Code, 2,500 square feet or more, but less than 5,000 square feet total gross floor area.
E. 
Type O uses:
(1) 
Business uses as defined in the latest edition of the BOCA Basic National Building Code, 5,000 square feet or more, but less than 7,500 square feet total gross floor area.
(2) 
Mercantile uses as defined in the latest edition of the BOCA Basic National Building Code, 5,000 square feet or more, but less than 7,500 square feet total gross floor area.
(3) 
Storage buildings as defined in the latest edition of the BOCA Basic National Building Code, 5,000 square feet or more, but less than 7,500 square feet total gross floor area.
(4) 
Eating and drinking establishments with fewer than 50 occupants.
F. 
Type P uses:
(1) 
Business uses as defined in the latest edition of the BOCA Basic National Building Code, 7,500 square feet or more, but less than 10,000 square feet total gross floor area.
(2) 
Mercantile uses as defined in the latest edition of the BOCA Basic National Building Code, 7,500 square feet or more, but less than 10,000 square feet total gross floor area.
(3) 
Storage buildings as defined in the latest edition of the BOCA Basic National Building Code, 7,500 square feet or more, but less than 10,000 square feet total gross floor area.
(4) 
Hotels and motels with 100 rooms or fewer and not defined as life hazard uses.
(5) 
Buildings where fewer than 100 persons assemble for the purpose of amusement, entertainment, recreation centers and health spas.
G. 
Type Q uses:
(1) 
Business uses as defined in the latest edition of the BOCA Basic National Building Code, 10,000 square feet or more total gross floor area.
(2) 
Mercantile uses as defined in the latest edition of the BOCA Basic National Building Code, 10,000 square feet or more total gross floor area and not defined as life hazard uses.
(3) 
Storage buildings as defined in the latest edition of the BOCA Basic National Building Code, 10,000 square feet or more total gross floor area.
(4) 
Factory and industrial uses as defined in the latest edition of the BOCA Basic National Building Code, not defined as life hazard uses.
H. 
Required inspections.

(1) 
Required inspections shall be performed as follows:
(a) 
Type M uses: once every 12 months.
(b) 
Type N uses: once every 12 months.
(c) 
Type O uses: once every 12 months.
(d) 
Type P uses: once every 12 months.
(e) 
Type Q uses: once every 12 months.
(2) 
All additional uses as listed in the aforementioned schedule shall be inspected for compliance with the provisions of this article periodically but not less than specified therein.
I. 
Registration fees.

(1) 
Registration fees for all additional uses shall be as follows:

(a) 
Type M uses: $125 per year.
(b) 
Type N uses: $150 per year.
(c) 
Type O uses: $200 per year.
(d) 
Type P uses: $250 per year.
(e) 
Type Q uses: $575 per year.
(2) 
When more than one additional use exists under one ownership at a given location, the highest use shall be registered at the full scheduled fee and subsequent use at 1/2 the scheduled fee.
(3) 
The fee schedule shall remain intact unless amended by ordinance by the Township.[2]

All penalties as indicated in the New Jersey Administrative Code (Uniform Fire Code, N.J.A.C. 5:70) shall be adopted for the purpose of enforcing this article except those penalties imposed as hereinafter provided for violations of this article not included within the Uniform Fire Code or authorized by the Uniform Fire Safety Act.
