The purpose of the within chapter is to require certain minimum regulation requirements for tattoo, body piercing and body burning businesses located within the Township of Hazlet as they apply to recordkeeping and minimum age requirements.
As used in this article, the following terms shall have the meanings indicated:
TATTOO or TATTOOING, BODY PIERCING AND BODY BURNING
Any placement or injection by means of a penetrating instrument, or in any other manner, of chemicals, substances, dyes or other materials upon or beneath the surface of the skin of a human being for the purpose of marking, decoration or other permanent alteration of the appearance of the skin surface.
It shall be a violation of the within chapter for anyone or any tattoo, body piercing and body burning business to tattoo, body pierce and body burn an individual under 18 years of age except as provided in § 400-4 of this article. Said establishment shall be responsible to review two types of identification proving an individual to be at least 18 years of age. Said proofs shall include at least one that is a photo identification and it shall be the responsibility of the proprietor to photocopy and maintain said submitted proofs for a period of three years, together with the following information concerning all tattoos, body piercing and body burning administered:
A. 
The date of the tattooing, body piercing and/or body burning.
B. 
The name, address and sex of the person tattooed, body pierced and/or body burned.
C. 
The name and address of the person performing the tattoo, body piercing and/or body burning operation.
D. 
The design, color or colors and location on the body of the tattoo, body pierce and/or body burn.
E. 
The dye or substance used in marking the skin.
F. 
The method of tattooing, body piercing and/or body burning.
If the person to be tattooed, body pierced and/or body burned is a minor under the age of 18 years, then it shall be required that the parent or guardian sign a consent to said tattooing, body piercing and/or body burning operation. The proprietor shall be responsible to keep photocopies of a least two forms of identification identifying the individual as the parent or a court order identifying the person as the guardian before allowing the minor to be tattooed, body pierced and/or body burned. Said records shall be kept for a period of three years as hereinabove described and all of the other information required by § 400-3 shall additionally apply.
No person or operator of any establishment shall state, represent, warrant or imply to customers, potential customers or the public at large that the tattooing, body piercing and/or body burning establishment is endorsed or its operation approved by the Township of Hazlet.
Tattooing, body piercing and/or body burning establishments shall be responsible for the proper sterilization and disposal of tattoo needles and medical wastes in accordance with any and all applicable county, state or federal regulations.
Any person who violates any one or more sections of this article shall be subject to a fine of not more than $1,000 for each separate offense and/or confinement in the Monmouth County Jail for a period of not more than 90 days.
