The Mayor shall preside at all meetings of the governing body and make procedural rulings. Any procedural rulings by the Mayor may be reversed by a majority vote of the Council members present. The Mayor shall have such powers as are expressly provided by statute and shall recommend to the Council such measures as he/she may deem necessary or expedient for the welfare of the Borough. The Council shall, in the exercise of its sound discretion, implement such recommendations of the Mayor which it deems to be necessary and expedient for the welfare of the Borough.
A President of the Council shall be elected annually as provided by statute and shall have such powers as provided by statute.
There is hereby established a Municipal Court of the Borough, which shall be conducted in accordance with the provisions of statute and the applicable rules of court.

A. 
There shall be a Judge of the Municipal Court who shall be appointed by the Mayor, with the advice and consent of the Council, and who shall serve for a term of three years from the date of his/her appointment and until his/her successor is appointed and qualified. The Judge shall be a resident of the State of New Jersey duly admitted to practice law as an attorney before the Supreme Court of New Jersey.
B. 
Said Municipal Court Judge shall have, possess and exercise all the functions, powers, duties and jurisdiction conferred by the provisions of Chapter 264 of the Laws of 1948, as amended and supplemented,[1] or by any other law.

A. 
The office of Borough Clerk is hereby established. The Borough Clerk shall have such duties as are provided by statute and the ordinances of the Borough. The appointment of the Borough Clerk shall be in accordance with the provisions of statute, and the terms shall be as provided by statute.
B. 
The salary of the Borough Clerk shall be as fixed from time to time by the annual Salary Ordinance.[1]

C. 
The Borough Clerk shall keep records, resolutions, ordinances and minutes of the meetings of the Council and shall issue all licenses required by law or ordinance, except such licenses which are assigned by law or ordinance to another issuing authority.
D. 
The Borough Clerk shall make all reports as required by law and shall give a monthly report to the governing body as to all fees received by him/her.
E. 
In addition to those powers and duties which are expressly provided by law, the Clerk shall also have those powers and duties which are from time to time assigned by the governing body.
F. 
The Borough Clerk shall be appointed by the Mayor with the advice and consent of the Council.
There is hereby established the office of Deputy Borough Clerk, who shall be appointed by the Council. The Deputy Borough Clerk shall have those duties which are assigned by the Borough Clerk and, during the absence or disability of the Borough Clerk, shall have all of the powers of the Borough Clerk and shall perform the functions and duties of such office.
A. 
There is hereby established the office of Municipal Attorney. The Municipal Attorney shall be appointed by the Mayor with the advice and consent of the Council and shall serve for such term as is provided by law.
B. 
The salary of the Municipal Attorney shall be as from time to time provided by the annual Salary Ordinance,[1] and he/she shall receive such additional compensation as shall be provided by the governing body.

C. 
The Municipal Attorney shall be an attorney at law duly admitted to practice in the State of New Jersey. He/she shall serve as legal advisor to the governing body and to all municipal officers, departments and boards, except as may be otherwise provided by statute or by ordinance.

The office of Prosecuting Attorney is hereby established. He/she shall be appointed by the Mayor with the advice and consent of the Council for a term of one year. He/she shall be an attorney at law duly admitted to practice in the State of New Jersey. He/she shall receive such compensation as shall be provided by the governing body. He/she shall conduct prosecutions in the Municipal Court and shall perform such other duties as are provided by law or the rules of court. The Prosecutor shall serve under the supervision of the Attorney General or County Prosecutor, who may represent the state, county or municipality in any matter within the jurisdiction of the Municipal Court.

The office of Borough Engineer is hereby established. He/she shall be appointed by the Mayor with the advice and consent of the Council for a term of one year. He/she shall be a duly licensed engineer of the State of New Jersey and shall receive such compensation as may be provided by the governing body. The Borough Engineer shall perform such duties as are prescribed by law and ordinance and such other duties which are from time to time assigned by the governing body.
A. 
There is hereby established the office of Superintendent of Public Works, who shall be appointed by the Mayor with the advice and consent of the Council, for a term of one year. He/she shall perform such duties as are provided by statute and such other duties as are from time to time assigned by the Council.
B. 
A person holding the position as full-time Municipal Superintendent of Public Works who has held the position continuously for five years or more shall continue to hold the position during good behavior and efficiency and shall not be removed therefrom for political or other reasons except for good cause, upon written charges filed with the Municipal Clerk and after a public, fair and impartial hearing. Such person may be retired when he/she shall have attained 70 years of age.

The following offices are hereby established:
(a) 
Deputy Tax Collector.
(b) 
Assessment Search Officer.
(c) 
Tax Search Officer.
(d) 
Treasurer.
(e) 
Municipal Court Administrator.
(f) 
Deputy Court Administrator.
(g) 
Violations Clerk.
(h) 
Borough Auditor.
(i) 
Chaplains.
(j) 
Surgeons and physicians.

Sewer System Operator.
(l) 
Assistant Sewer System Operator.
(m) 
Chief Financial Officer.
(n) 
Tax Collector.

(2) 
These officers shall be appointed by the Mayor with the advice and consent of the Council for terms of one year and shall perform such duties as are provided by law and as are assigned from time to time by the Council.
B. 
There shall be an office of Tax Collector consisting of a Tax Collector. The Borough Tax Collector shall be appointed by the Mayor with the advice and consent of the Council for a term of four years. The Tax Collector shall be qualified in accordance with the requirements of N.J.S.A. 40A:9-145.7, as may be amended and/or supplemented. The Borough Tax Collector shall perform each and every duty as provided by law and assigned from time to time by the governing body.

C. 
There shall be an office of Tax Assessor, consisting of a Tax Assessor, who shall be appointed by the Mayor with the advice and consent of the Council for a term of four years. The Tax Assessor shall hold a Tax Assessor certificate as provided in N.J.S.A. 54:1-35 et seq. and shall perform each and every duty as provided by law and assigned from time to time by the governing body.

D. 
Qualified Purchasing Agent.

(1) 
The Qualified Purchasing Agent is required to possess a valid Qualified Purchasing Agent Certificate, as issued by the New Jersey Division of Local Government Services, Department of Community Affairs.
(2) 
The Qualified Purchasing Agent shall have, on behalf of the Mayor and Council of the Borough of North Haledon, the authority, responsibility, and accountability for: the purchasing activity pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., to prepare public advertising for and to receive bids and requests for proposals for the provision of goods, services, and construction contracts; to award contracts pursuant to New Jersey law in accordance with the regulations, forums, and procedures promulgated by state regulatory agencies; the establishment and enforcement of any and all local purchasing policies adopted by the governing body; the purchasing and claims-approval authority of the Borough Purchasing Officer set forth by ordinance; and the conduct of any activities as may be necessary or appropriate to the purchasing function of the Borough of North Haledon.
(3) 
Upon appointing a Qualifying Purchasing Agent pursuant to N.J.S.A. 40A:11-9, the Borough may take advantage of the higher bid threshold (currently, $40,000, with a quote threshold of 15% or $6,000), pursuant to N.J.S.A. 40A:11-3(a), as such threshold may be adjusted from time to time pursuant to N.J.S.A. 40A:11-3(e), but may, at its discretion, go to bid at a lower amount to encourage greater competition among bidders.

The Council at the annual reorganization meeting shall appoint the following Council committees: Department of Public Works/Sewers/Solid Waste/Recycling; Finance/Personnel; Fire and Water; Police/OEM and Health and Safety PBA 292; Insurance; Engineering. Each committee shall consist of three Council members, and the first named shall be the Committee Chairperson. The Chairperson of the Police Committee shall be known as the "Police Commissioner," and the Chairperson of the Fire Committee shall be known as the "Fire Commissioner."
A. 
The following committees may be established: Building Advisory Committee; Solid Waste Committee; Swimming Pool Committee; Senior Citizen Committee; Pollution Control Committee; Citizens Community Planning Committee; Park Development Committee; Recreation Advisory Committee; Public Information Committee; and any other committee as may be deemed appropriate by the governing body.

B. 
Each of the members of the committees shall be appointed by the Council for terms of one year. The number of members of each committee shall be within the discretion of the Council. They shall perform such duties as are from time to time assigned to them by the Council.
C. 
The Mayor may appoint a Council representative/liaison to the following, but not limited to the following: Local Board of Education; Regional Board of Education; Board of Recreation Commissioners; Ambulance Corp.; Manchester Regional Withdrawal; Passaic County Planning Board; Passaic County Solid Waste Advisory; and the following ad hoc committees: Codification Review Committee; Buehler's Committee; Playground Committee; Public Celebrations Committee; and New Recreation Building Committee.

A. 
The office of Public Defender is hereby established. He/she shall be appointed by the Mayor with the advice and consent of the Council for a term of one year. He/she shall be an attorney at law duly admitted to practice in the State of New Jersey. He/she shall receive such compensation as shall be provided by the governing body. He/she shall appear in the Municipal Court and perform the services of the Public Defender whenever same are required.
B. 
Any person who shall apply to the North Haledon Borough Municipal Court for the appointment of an attorney or a municipal public defender to represent them, where such person is entitled by law to the appointment of counsel, shall pay the Borough of North Haledon an application fee in accordance with Chapter 275, Fees. The Borough of North Haledon Municipal Court may waive such required application fee in whole or in part if the court determines, in its discretion, the applicant fee represents an unreasonable burden on the person seeking such representation.

A. 
Office established. There is hereby created the office of Municipal Humane Law Enforcement Officer for the Borough of North Haledon.
B. 
Appointment and term. The Mayor, upon recommendation of the Chief of Police, shall appoint, with the advice and consent of the Council, a Municipal Humane Law Enforcement Officer for a term of one year commencing January 1 and terminating December 31 in each year or the unexpired portion thereof.
C. 
Powers and duties. The Municipal Humane Law Enforcement Officer shall exercise the following powers and duties, including but not limited to:
(1) 
Enforce all animal welfare and animal cruelty laws and ordinances;
(2) 
Investigate and sign complaints concerning any violation of animal welfare or animal cruelty laws or ordinances;
(3) 
Act as an officer for the detection, apprehension and arrest of offenders against the animal welfare and animal cruelty laws and ordinances;
(4) 
Enforce and abide by the provisions of N.J.S.A. 4:22-1[1] et seq.; and,

(5) 
Such other powers and duties required under ordinance or at law.
D. 
Firearm authority. The Municipal Humane Law Enforcement Officer shall be authorized to possess, carry and use a firearm while enforcing the laws and ordinances enacted for the protection of animals, provided that such officer qualifies and maintains all certification and training requirements required by law.
