[Adopted as Ch. 150, Art. IV, of the 1990 Code]
This article may be cited as the "North Haledon Street Ordinance."
The purpose of this article is to provide rules, regulations and minimum standards to govern the construction and reconstruction of rights-of-way in the Borough, including street pavements, sidewalks, curbs, driveway approaches and stormwater and subsurface water drainage, either in connection with applications for subdivision of land or otherwise, unless such construction is solely under the jurisdiction of the County of Passaic or the State of New Jersey or where standards differing from those hereinafter set forth are required in order to obtain permission to construct or funds to construct, or both, from the County of Passaic, the State of New Jersey or the United States of America. Nothing contained herein shall constitute any limitations upon the statutory right of the Council to certify improvements to be made on an unimproved street as a precondition to the issuance of a building permit.
As used in this article, the following terms shall have the meanings indicated:
BOROUGH ENGINEER
The person designated by the Borough Council as Borough Engineer, or, in the event that the Borough Engineer shall have been privately retained by any person for any purpose coming under the purview of this article, then the licensed engineer specially retained by the Borough Council in connection with such purpose.
CONSTRUCTION OFFICIAL
The person designated by the Borough Council as Construction Official or his/her duly authorized representative.
SUBDIVISION
As ascribed in the laws of the State of New Jersey and in the ordinances of this Borough relating to subdivisions.[1]

The construction of all streets, sidewalks, curbs and driveway approaches in the Borough and the establishment, in connection with such construction, of systems for the drainage of stormwater and subsurface water shall be in accordance with the specifications of the New Jersey State Highway Department in force on July 13, 1966, and any addenda and amendments thereto subsequent to that date, and the further specifications set forth in § 523-23 and the Plan for Construction of Pavement, Curbing, Sidewalks and Driveways in the Borough of North Haledon, Passaic County, New Jersey, Richard P. Browne, Borough Engineer, 1966. In the event that the specifications set forth in § 523-23 or the plan of the Borough Engineer are inconsistent with the specifications of the State Highway Department, then the State Highway Department specifications shall prevail.
The plan of the Borough Engineer is hereby adopted as part of this article as fully as if set out herein, to be advertised and promulgated as a part hereof, and shall be attached to and form an integral part of this article in its distribution and enforcement.
All streets and roads constructed and reconstructed in the Borough shall be paved with seven-and-one-half-inch bituminous concrete pavement, which pavement shall consist of a four-inch macadam foundation course, a two-inch bituminous concrete binder course and a one-and-one-half-inch bituminous concrete surface course and shall be constructed according to the following specifications:
A. 
Four-inch macadam foundation course.
(1) 
Description. The macadam foundation course shall consist of the construction of a pavement base course of macadam and the preparation of the subgrade.
(2) 
Materials. The materials for large aggregate and screening shall be broken stone of traprock, granite, gneiss, dolomite, limestone or blast furnace slag. The large aggregate shall be two-and-one-half-inch size. The materials shall conform to the requirements of Article 8.5.5 and Article 8.5.7, respectively, of the New Jersey State Highway Department Standard Specifications 1961.
(3) 
Methods of construction.
(a) 
No stone shall be laid on the subgrade until the subgrade has been thoroughly inspected by the Construction Official and meets his/her approval.
(b) 
Macadam foundation course shall be constructed of two-and-one-half-inch crushed stone rolled to a minimum thickness of four inches with a three-wheel power roller weighing not less than 10 tons and a weight on the rear rolls of not less than 330 pounds per inch of width of roll. The rolling shall begin at the sides and progress to the center parallel with the center line of the road. After the stone has been properly rolled, stone dust shall be spread over its surface and worked into the voids. This dust shall be applied in thin layers with intermittent rolling between each application. After completion of the rolling, the entire base surface shall be broomed and swept so no surplus stone dust remains on the surface. The faces of two-and-one-half-inch stones shall show clean and clear. Spots that have become loose, raveled or rutted shall be repaired and rerolled to the satisfaction of the Construction Official.
(c) 
The macadam foundation shall not be constructed more than two weeks prior to the time that the bituminous surface is to be applied. The contractor or developer shall repair any foundation defects to the satisfaction of the Construction Official if construction procedure is otherwise.
(4) 
Subgrade. All topsoil shall be stripped from the proposed subgrade. The subgrade when completed shall be true to the lines, grades and cross sections given on an approved plan or as directed by the Construction Official. After the subgrade has been shaped correctly, it shall be brought to a firm, unyielding surface by rolling the entire area with a three-wheel power roller weighing not less than 10 tons. All soft and spongy places shall be excavated and refilled solidly with subbase consisting of broken stone, broken slag, gravel, suitable earth or sand as directed by the Construction Official. All loose rock or boulders shall be removed or broken off six inches below the subgrade surface. All stumps shall be removed in their entirety. This shall be done before completing the rolling of the entire surface of the subgrade.
B. 
Two-inch bituminous concrete binder course Type CABC.
(1) 
Description. Bituminous concrete binder course CABC. The bituminous concrete for Type CABC shall be composed of coarse aggregate, fine aggregate, mineral filler and bituminous material.
(2) 
Material.
(a) 
Bituminous material shall be asphalt cement, Penetration Grade 85-100, conforming to the requirements therefor as specified in Article 8.1.2 of the New Jersey State Highway Department Standard Specifications 1961.
(b) 
Coarse aggregate shall be broken stone of three-fourths-inch size prepared from traprock, gneiss, granite or dolomite, conforming to the quality requirements as specified, respectively, therefor in Article 8.5.5. The grading requirements shall conform to Article 8.5.4, Table 28, of the New Jersey State Highway Department Standard Specifications 1961.
(c) 
Fine aggregate shall conform to the requirements specified therefor in Article 8.5.12 of the New Jersey State Highway Department Standard Specifications 1961.
(3) 
Methods of construction.
(a) 
The bituminous concrete binder course Type CABC-1 two inches thick shall be spread by a bituminous concrete paver, which shall be self-contained, power-propelled, provided with an activated screed or strike-off assembly and shall meet the requirements as specified therefor in Article 3.10.3 of the New Jersey State Highway Department Standard Specifications 1961.
(b) 
The mixture shall be laid only upon a base which is dry and when the weather conditions are suitable in the opinion of the Construction Official. The mixture shall be spread and struck off so as to obtain, after compaction, the grade and crown shown on the plans or adjustments thereof made or ordered by the Construction Official.
(c) 
On areas where irregularities or unavoidable obstacles make the use of self-powered spreading and finishing equipment impracticable, in the judgment of the Construction Official, the mixture may be spread and raked by hand. On such areas, the mixture shall be dumped on steel dump boards and spread and raked to give the thickness of material required.
(d) 
After the mixture has been properly spread, initial compaction shall be obtained by rolling with a three-wheel power-driven roller having a load of not less than 330 pounds per inch of width of rear wheel and a total metal weight of not less than 10 tons.
(e) 
Subsequent rolling shall be done with a two-axle tandem roller, which shall be power-driven and shall have a load not less than 250 pounds per inch of width of tread of drive roll and shall have a total metal weight of not less than eight tons.
(f) 
Rolling shall begin at the sides and progress gradually to the center until the entire surface has been rolled by the rear wheels. If the width of the binder course permits, it shall be subjected to a diagonal rolling in two directions, the second diagonal rolling crossing the lines of the first.
(g) 
Any pavement that becomes loose and broken or mixed with dirt or is in any way defective shall be removed and replaced with fresh hot mixture, which shall be immediately compacted to conform to the surrounding area. Any area showing an excess of bituminous material shall be removed and replaced.
(h) 
The final compacted thickness shall not be less than two inches.
C. 
One-and-one-half-inch bituminous concrete surface course Type FABC.
(1) 
Description. Bituminous concrete surface course FABC. The bituminous concrete for Type FABC shall be composed of coarse aggregate, fine aggregate, mineral filler and bituminous material.
(2) 
Material.
(a) 
Bituminous material shall be asphalt cement, Penetration Grade 85-100, conforming to the requirements therefor as specified in Article 8.1.2 of the New Jersey State Highway Department Standard Specifications 1961.
(b) 
Coarse aggregate shall be broken stone of three-eighths-inch size prepared from traprock, gneiss, granite or dolomite, conforming to the quality requirements as specified, respectively, therefor in Article 8.5.5. The grading requirements shall conform to Article 8.5.4, Table 28, of the New Jersey State Highway Department Standard Specifications 1961.
(c) 
Fine aggregate shall conform to the requirements specified therefor in Article 8.5.12 of the New Jersey State Highway Department Standard Specifications 1961.
(3) 
Method of construction.
(a) 
The bituminous concrete surface course Type FABC-1 1 1/2 inches thick shall be spread by a bituminous concrete paver, which shall be self-contained, power-propelled, provided with an activated screed or strike-off assembly and shall meet the requirements as specified therefor in Article 3.10.3 of the New Jersey State Highway Department Standard Specifications 1961.
(b) 
The mixture shall be laid only upon a base which is dry and when the weather conditions are suitable in the opinion of the Construction Official. The mixture shall be spread and struck off so as to obtain, after compaction, the grade and crown shown on the plans or adjustments thereof made or ordered by the Construction Official.
(c)

(d) 
After the mixture has been properly spread, initial compaction shall be obtained by rolling with a three-wheel power-driven roller having a load of not less than 330 pounds per inch of width of rear wheel and a total metal weight of not less than 10 tons.
(e) 
Subsequent rolling shall be done with a two-axle tandem roller, which shall be power-driven and shall have a load of not less than 250 pounds per inch of tread of drive roll and shall have a total metal weight of not less than eight tons.
(f) 
Rolling shall begin at the sides and progress gradually to the center until the entire surface has been rolled by the rear wheels. If the width of the surface course permits, it shall be subjected to a diagonal rolling in two directions, the second diagonal rolling crossing the lines of the first. Rolling shall be continued until all roller marks are eliminated and the finished surface meets the requirements specified under "Surface Requirements" of the New Jersey State Highway Department Standard Specifications.
(g) 
Along curbs and at other places not accessible to the roller, the mixture shall be thoroughly compacted with hot hand or mechanical tampers and smoothing irons, which shall be suitable to the Construction Official.
(h) 
Any pavement that becomes loose and broken or mixed with dirt or is in any way defective shall be removed and replaced with fresh hot mixture, which shall be immediately compacted to conform to the surrounding area. Any area showing an excess of bituminous material shall be removed and replaced.
(i) 
The final compacted thickness shall not be less than 1 1/2 inches.
(j) 
No bituminous concrete material shall be placed when the atmospheric temperature is below 50° F., except when approved by the Construction Official, or when the weather is foggy, rainy or otherwise unfavorable in the opinion of the Construction Official.
D. 
Stormwater drainage systems. All stormwater drainage systems shall be designed based upon a ten-year storm or two inches of rainfall in a period of one hour.
A. 
The aforementioned specifications and plans shall be construed both to establish minimum standards for all items of improvement set out therein and to require the installation of all such items of improvement in the manner set out therein to the end that all rights-of-way shall be required to have paving, curbing, sidewalks and driveway approaches constructed in the manner required by the standards and to have provisions, acceptable to the Borough Engineer, for stormwater and subsurface water drainage.
B. 
Where, as to any presently existing streets, the existing width is less than the standard set out in the Master Plan of the Borough or some question exists as to the future alignment or widening of such street or such street has a slope in excess of 12%, the Planning Board or the Mayor and Council, as the case may be, may make such relaxation of these requirements as the particular circumstances shall require.
No construction or reconstruction contemplated by this article shall be undertaken until plans and specifications for the same drawn to scale and complete in all details and prepared by a licensed professional engineer are approved by the Borough Engineer. This approval shall in no way supersede any other approval required by ordinance or law.
The contractor shall notify the Borough Engineer and the Construction Official of the Borough at least 48 hours prior to the time he/she intends to commence or continue to install any or all improvements, and under no condition shall the contractor perform any work without the written consent of the Construction Official. Failure to do so shall result in work stoppage, and the contractor shall be required to furnish proof satisfactory to the Construction Official that work done without the Superintendent's consent is acceptable under this article.
No right-of-way or street shall be accepted by the Borough Council of the Borough until:
A. 
The Construction Official, upon the making of such progress inspections as he/she shall consider necessary, shall report his/her written findings to the Borough Engineer and the Borough Council.
B. 
The Borough Engineer has certified that all improvements have been installed in accordance with this article.
C. 
There shall have been presented to the Borough Council a duly executed deed of dedication, together with either a policy of title insurance or a certificate of title over the hand of any attorney at law of New Jersey, all acceptable to the Borough Attorney.
No final application for a major subdivision, as such major subdivision is defined in the ordinances of this Borough, shall be approved by the Planning Board of the Borough unless the person making such application shall have complied or shall give assurances, in the manner required by Chapter 530, Subdivision of Land, that he/she will comply with the provisions of this article.
All costs and expenses, including the expenses of engineering data, inspection and supervision, deeds of dedication, policies of title insurance and certificates of title, shall be borne by the contractor.

Any person who violates any provision of this article shall, upon conviction thereof, be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty. Each day that a violation is permitted to exist shall constitute a separate offense.
