Members of the Police Department are hereby authorized to remove a vehicle from a street or land owned or leased and maintained by the municipality or the Board of Education or private property, including any lands devoted to the public parking of vehicles, to the nearest garage or other place of safety or to a garage designated or maintained by the Police Department or otherwise maintained by this Borough under the circumstances hereinafter enumerated. The Police Department or the Property Maintenance Officer are hereby authorized to issue notices of violations to the owner pursuant to this chapter to effectuate the purposes of this chapter.

A vehicle shall be considered abandoned if it has been parked continuously on a public highway, street or land owned or leased and maintained by the municipality or the Board of Education, including any lands devoted to the public parking of vehicles, for a period in excess of 48 hours. A vehicle shall also be considered abandoned on private property if it is either:
A. 
Unregistered or uninsured and parked in the open and in plain view; or
B. 
In a state of disrepair rendering the vehicle unmovable on its own and present on such private property for a period of 30 days.
Immediately after a vehicle is so removed, the Chief of Police, or such member acting for him/her, shall notify the registered and legal owner, in writing, by personal service or by registered mail, at the last known address of the owner, of the removal of such vehicle and the reason for the same and the location of the vehicle.

The vehicle shall be retained and impounded until the person owning the vehicle shall pay the reasonable cost of such taking and removal, together with a garage charge as provided in Chapter 275, Fees, for each and every day such vehicle is retained and impounded.

After a reasonable time, title to the vehicle passes to the Borough of North Haledon. Upon transfer of title, the Police Committee shall decide in what manner the car will be disposed of. The options shall include, but are not limited to, public auction, transfer of ownership to the Borough or transfer of ownership to the garage in possession for a reasonable fee.

Any person who violates any provision of this chapter shall, upon conviction thereof, be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty. Each day that a violation is permitted to exist shall constitute a separate offense.
