There shall be a Municipal Court in the City pursuant to the
provisions of N.J.S.A. 2B:12-1 et seq., to be known as the "Municipal
Court of the City of Union City, Hudson County." The Municipal Court
shall have a seal bearing the impress of the name of the Court. The
Court shall be held in the City Hall of the City or such other place
as the Board of Commissioners shall designate from time to time, and
shall exercise all the functions, powers, duties and jurisdiction
conferred by law upon municipal courts.
A.
There shall be two municipal judges of the Municipal Court who shall
each serve for a term of three years from the date of appointment
and until a successor shall be appointed and qualified.
B.
Each municipal judge shall have and possess the qualifications and
shall have, possess and exercise all the functions, duties, powers
and jurisdiction conferred by law or ordinance. They need not be residents
of the City, and shall be attorneys at law of the State of New Jersey.
Whenever a Municipal Judge shall be unable to sit as such, that Judge
may designate any other Judge of any Municipal Court (except a nonattorney
Judge) or an attorney at law to sit for him/her temporarily and hold
the Municipal Court. Any such designation shall be made in writing
and shall be filed in the Court, and any person so designated, while
sitting temporarily, shall possess all the powers of the Municipal
Judge.
A.
Position established. There is hereby created the office of Municipal
Court Administrator.
B.
Appointment; term. The Municipal Court Administrator shall be appointed
by and be responsible to the Director of Public Affairs. Such appointment
shall be for a term of two years.
C.
Qualifications.
(1)
Qualifications for the position of Municipal Court Administrator
are as follows:
(a)
Five years of Municipal Court experience.
(b)
A knowledge of budgeting, staff training, evaluation, requirement
for short- and long-range planning.
(c)
Organizational abilities and the ability to provide effective
policies and procedures and prepare statistical and other reports
as to any finding, conclusion and recommendations.
(d)
The ability to assign and supervise work assignments.
(2)
Additional consideration shall be given to applicants with bilingual
ability in Spanish.
D.
Duties. The Municipal Court Administrator shall:
(1)
Supervise and have charge of office procedures and administrative
functions of the Court.
(2)
Prepare and supervise the annual budget for the Municipal Court.
(3)
Supervise the development and maintenance of computerized traffic
case processing.
(4)
Supervise the collection of fines and disbursement of funds.
(5)
Assure the proper maintenance of all necessary recordkeeping.
(6)
Oversee criminal case processing and maintenance and control of the
Court calendar.
(7)
Supervise the work performed by the nonjudicial staff.
(8)
Institute and plan for short- and long-term goals and objectives
of the Municipal Court.
(9)
Prepare or direct the preparation of statistical, financial, progress
and other reports related to the work of the Court, as may be required
by regulation, directed by the Director of Public Affairs or requested
by the Judge, complete with findings, conclusions and recommendations,
where applicable.
(10)
Supervise the maintenance of all required and necessary records of
the Court.
(11)
Study and develop effective and improved methods of Court functioning,
especially the mechanization and computerization of Court operation.
(12)
Procure supplies and services for the Court.
(13)
Such other duties required or assigned for the efficient and effective
operation of the Municipal Court.
E.
Compensation. The Municipal Court Administrator shall receive a salary
as set forth in the annual Salary Ordinance.
A.
Position established. There is hereby created the position of interpreter,
assigned to the Municipal Court, in the Department of Public Affairs.

Responsibilities. The interpreter shall:

Qualifications. The qualifications of the interpreter, assigned to
the Municipal Court, shall be:
(1)
The ability to read, write, speak and understand English sufficiently
to perform the duties of the position.
(2)
A thorough knowledge of the concerned Spanish language.
(3)
The ability to interpret and translate the Spanish language and to
be courteous with individuals.
(4)
Good health and freedom from disabling physical and mental defects
which would impair the proper performance of the required duties or
which might endanger the health and safety of oneself or others.
D.
Appointment; salary. The appointment of the interpreter shall be
made by the Director of the Department of Public Affairs. The salary
shall be as set forth in the annual Salary Ordinance.
