[HISTORY: Adopted by the Town Board of the
Town of Grand Island 8-19-1996 by L.L. No. 2-1996 (Ch.
26B of the 1963 Code). Amendments noted where applicable.]
No person shall enter or remain in a park, playground
or recreation facility owned and/or maintained by the Town of Grand
Island between sunset and sunrise the following day except:
A.
Where a person is traveling to or from or is participating
in an event or activity under the direct supervision of the Town of
Grand Island.
B.
Where a person is traveling to or from or is participating
in the use of a facility or location for which use the Town has issued
a special permit to allow the use thereof by said person during such
hours.
C.
Where the Town has established an alternate time frame
for a specific event in a park.
D.
Through
traffic traversing Veterans Park on designated roadways.

No person shall drive or cause to be driven
along or over any road within any Town park any vehicle at a speed
in excess of that posted. All vehicles are prohibited from driving
in unauthorized areas such as, but not limited to: turf areas, bicycle
paths, walking/jogging paths, sidewalks and courts. Parking shall
be restricted to parking lots or where specifically allowed by sign
or permit.
A.
No person shall bring any animal or animals into any public park unless the same are on a leash not exceeding six feet in length, kept on a leash while in the park area and under the control of a responsible person. There shall be an exception for animals "at large," under § 101-3, the definition of "at large," Subsections A through C.

B.
It shall be the duty of every person having possession,
custody or control of an animal to remove and lawfully dispose of
any feces left by said animal in any public park or park approach.
C.
No person shall use, ride or drive a horse in any
park area except in an area designated for such purpose.

A.
No person shall climb any tree or injure, deface,
disturb or befoul any part of a Town park or any building, signs,
equipment or other property found therein or remove, cut down, cut,
injure or destroy any tree, flower, shrub or ornament, statue, fence,
bridge, structure or other property within any park or park approach
or within any other area under the control of the Director of Parks
and Recreation.
B.
No littering shall be allowed in the parks, and all
refuse, rubbish and garbage of all types shall be placed in receptacles
provided for said purpose.
C.
No glass beverage containers shall be allowed on park
grounds.
No person shall kindle, build, maintain or use
a fire in any Town park or park approach for any purpose except in
a stove, fireplace, oven or fire circle provided for that purpose.
A fire shall be continuously under the care and direction of a competent
person from the time it is kindled until it is extinguished. Lighted
matches, cigarettes, cigars or burning tobacco must not be deposited
or left where they may cause fires.

A.
No person shall hunt or trap within the boundaries of a Town park.
No person shall trap on any other Town-owned property except in accordance
with applicable law, and upon issuance of a permit by the Town Board.
For purposes of this chapter, "hunt/hunting" and "trap/trapping" shall
have the meanings set forth in § 11-0103(10) and (11) of
the New York Environmental Conservation Law.
B.
An application for a trapping permit must be accompanied by the required
permit fee, set by the Town Board in its fee schedule, and must contain:
(1)
The name and address of the person(s) requesting permission to trap
on Town property.
(2)
The specific area on Town property where the applicant(s) proposes
to trap.
(3)
A demonstration that the applicant(s) has the required permits and
training to trap as required by the New York Environmental Conservation
Law and applicable regulations.
(4)
A narrative with the application setting forth the reasons why the
permit is being sought.
C.
Any application for a trapping permit and any supporting documentation shall be filed with the Town Clerk along with the appropriate fee. The Town Clerk shall distribute copies of the application to the Town Board and to the Town's Conservation Advisory Board for consideration of the criteria set forth in Subsections B and E. Within 31 days of receipt of a completed application, or such longer period as may be agreed with the applicant, the Conservation Advisory Board may make a written recommendation to the Town Board for approval of the trapping permit as requested, or with such modifications as the Conservation Advisory Board determines necessary and appropriate, or denial. Thereafter, and within 62 days of receipt of a completed application, or such longer period as may be agreed upon with the applicant, the Town Board may approve the trapping permit as requested, or with such modifications as the Town Board determines necessary and appropriate, or may deny the application.
D.
The Town Board may, by resolution, designate certain Town-owned property
as being appropriate for trapping during the applicable New York trapping
season after receiving recommendations from the Town's Conservation
Advisory Board and the Parks and Recreation Advisory Board.
E.
In evaluating an application for a trapping permit, the Town Board shall consider the impacts of the proposed permit to the health, safety, and welfare of the community, the surrounding land uses, the current and potential use of the property at issue, the qualifications and experience of the applicant(s), and any other factor that the Town Board deems reasonable. No permit shall be granted unless the applicant(s) has demonstrated the requisite qualifications to trap, as set forth in Subsection B(3) above.
No person shall fire or discharge any gun, pistol,
firearm or slingshot, torpedo or other fireworks of any description
or carry or transport the same in any park unless upon permission
of the Town Board.
No person, firm or corporation shall sell or
offer for sale within the Town parks any property or privilege whatsoever
unless authorized by the Town Board or Recreation Department.
No person shall bring into a Town park, use,
consume or have in his possession any alcoholic beverage unless that
person has been issued a written permit by the Town of Grand Island
or the Town Recreation Department allowing the possession, use and
consummation of alcoholic beverages.
Golfing or practice golfing is restricted to
area(s) established for said purpose.
No person shall bathe, wade or swim in any waters,
pools or lakes except at such times and in such places as the Director
of Parks and Recreation may designate or maintain as bathing areas.
No person shall bring into a Town park, use
or have in his possession while there any implement or device commonly
used for gambling purposes.
The Town Board or Recreation Department of the
Town of Grand Island may designate buildings, shelters and locations
within the parks and recreation areas of the Town which may be reserved
for the exclusive use by a group or persons. No person or persons
of a group shall occupy or use any such building, shelter or location
unless such use has been authorized by the Town through the issuance
of a special permit. Application for such permit shall be made to
the Recreation Department of the Town and shall include such information
and certification as required by the Recreation Department or the
Town Board. Such application may be granted or denied under such circumstances
and conditions as prescribed by the Town Board or Recreation Department.
Such permit shall be in a form prescribed by the Recreation Department
and shall be available for inspection by any Town official or employee
during the time the permit is operative. Such permit may provide for
an exception to any applicable local laws and ordinances and in such
a case shall state the terms and conditions under which said exceptions
shall apply. Such permit may be revoked at any time by the Town Board,
Recreation Department or law enforcement officers of the Town upon
reasonable belief of a violation of any of the conditions under which
the permit was issued. Scheduled events have first priority.
It shall be the duty of every person entering
and using the facilities of Town parks to conduct himself/herself
in a lawful manner with respect to the safety, well-being and enjoyment
of others.
Model flying airplanes are to be operated in
designated areas and times only. Prior permit is required with AMA
certification. Registration with Park and Recreation Department is
required.
A.
Any violation by a person, firm or corporation of
any provision of this chapter shall be deemed a violation punishable
by a fine not to exceed $250 or by imprisonment for a period not to
exceed 15 days, or both.[1]
B.
Any person who takes part in or assists in any violation
of this chapter shall also be subject to the penalties provided herein.
C.
Each day that a violation of this chapter is committed
or permitted to exist shall constitute a separate offense.
D.
Any person or persons violating said rules and regulations
shall be subjected to removal from the park property by law enforcement
officers.
