§ 14-13Adoption of agreement.
§ 14-14Findings.
An agreement entitled "New Brighton Area Recreation Commission – An Intergovernmental Agreement of Cooperation," dated December 1, 2002, hereinafter referred to as "agreement" or "Joint Recreation Agreement," between New Brighton Area School District, New Brighton Area Recreation Authority, Daugherty Township, Pulaski Township, Fallston Borough and New Brighton Borough, a copy of which is attached hereto as Exhibit A and made a part hereof, is hereby adopted and approved by the Township of Daugherty.
As required by the Intergovernmental Cooperation Act,
The conditions of the agreement are as set forth in the Joint Recreation Agreement, dated December 1, 2002, and are adopted by reference, with the same effect as if it had been set out verbatim in this section, a copy of which shall be filed with the minutes of the meeting at which this article was adopted.
The duration of the initial term of the agreement is five years, after which Daugherty Township's participation is as set forth in the Joint Recreation Agreement, dated December 1, 2002.
The purpose and objectives of the agreement, including the powers and scope of authority delegated in the agreement, are as set forth in the Joint Recreation Agreement, dated December 1, 2002.
The manner and extent of financing are as set forth in the Joint Recreation Agreement, dated December 1, 2002.
The Chairman of the Board of Supervisors and the Township Manager are hereby authorized and directed to sign the agreement on behalf of the Township of Daugherty.
The agreement marked as Exhibit A is entered into by and between the participants pursuant to the authority granted to the participants by the area government and Intergovernmental Cooperation Act, 1996, Dec. 19, P.L. 1158, No. 177 (53 Pa.C.S.A. § 2301 et seq.).
The agreement shall be in full force and effect upon the execution of said agreement by all of the participants and the adoption by the participants of an ordinance or resolution authorizing the same.
