Indiana Borough shall enter into an agreement with Blairsville Borough for the creation of a Council of Governments, as provided for in the Intergovernmental Cooperation Act of 1996, P.L. 1158, No. 177 (53 Pa.C.S.A. § 2301 et seq.) as amended, for the purpose of acquiring equipment for use on the sanitary and storm sewer systems located within each municipality.

The duration of the Council of Governments shall be for five years, and shall continue for additional five-year terms thereafter unless terminated by Blairsville Borough or Indiana Borough. Blairsville Borough and Indiana Borough shall each have the right to terminate the agreement upon notice to the other party 12 months in advance of the date the termination is to be effective.
Financing of any equipment purchased under the Council of Governments shall be accomplished by Indiana Borough supplying 60% of the funds necessary for acquisition and Blairsville Borough supplying 40% of the funds necessary for acquisition. Any income earned or costs incurred in the operation, maintenance, use or disposal of the equipment owned by the Council of Governments shall be allocated 60% to Indiana Borough and 40% to Blairsville Borough.
The organizational structure necessary to implement the agreement shall consist of a COG Board, which shall have two members appointed by Indiana Borough and two members appointed by Blairsville Borough.
A. 
Any property, real or personal, owned by the Council of Governments shall be titled as "Blairsville Borough/Indiana Borough/Council of Governments."
B. 
Property, real or personal, of the Council of Government shall be acquired, managed, licensed or disposed of by action of the COG Board and as provided in the agreement referred to above.
Indiana Borough consents to Blairsville Borough assigning all of its rights and obligations hereunder to another entity, providing written consent is given by Indiana Borough which shall not be unreasonably withheld.
The entity created under this chapter shall be empowered to enter into contracts for policies of group insurance and employee benefits, including social security, for its employees.
