Solid waste recycling shall be conducted at the Township recycling center located on Pill Hill Road and shall be regulated as hereinafter provided.
Use and access to the recycling center shall be restricted to persons residing in the Township for the disposal of their personal household recyclables and as otherwise provided in Section 18-5. Permits which allow residents four free credits per calendar year for the purpose of disposing of bulky household waste items are available through the Public Works Department. Credits are based upon the local capacity of the vehicle used to transport the waste. The number of credits to be charged per visit shall be:

Residents will be required to show the permit and drivers license showing Bernards Township address before entering the facility. Residents not displaying a permit, or having disposal requirements in excess of the four free credits will be required to pay a fee. Residents without a permit or after using up their four free credits may bring household bulky waste items to the recycling area for disposal by paying a fee. Charges will be made for household bulky waste disposal based on vehicle type and shall be set from time to time by resolution of the Township Committee.

No scavenger or vehicle or truck collecting refuse in the Township or otherwise shall be permitted access to or use of the Township recycling center. No commercially licensed vehicles, except those registered to a resident at the residential address, shall be permitted access to or use of the Township recycling center.

Business and commercial interests physically located within the limits of the Township (excluding business commonly known as "scavengers") may be permitted use of and access to the Township recycling center for disposal of bulky waste and recyclable materials that originate on their own property, but not that of their customers, in accordance with the rules and regulations promulgated by the Public Works Department pursuant to Subsection 18-5.7.

The hours of operation of the recycling center, which shall be incorporated in the rules and regulations promulgated by the Public Works Department, shall be as follows:
a.
April through October: Saturdays, 8:00 a.m. to 5:00 p.m.
b.
November through March: Saturdays, 8:00 a.m. to 4:00 p.m.
c.
April, May, June, October and November: Sundays, 12:00 noon to 4:00 p.m.
Additional hours of operation can be instituted and advertised at the discretion of the Director of Public Works, upon approval by the Township Administrator. |

The operation and regulation of use and access to the Township recycling center and for the obtaining of resident permits and special permits shall be in accordance with rules and regulations adopted by the Public Works Department of the Township. Such regulations shall be consistent with this section and shall govern the permissible materials and substances to be allowed in the recycling center and permit procedures, fees and all other rules and regulations relating to the operation of the recycling center.

Any violation of this section is subject to the penalty as stated in Chapter III, Section 3-1.

The gate attendant has the right to inspect the recyclables to determine its type and origin and compliance with the rules and regulations. Any noncompliance or noncooperation with regulations or directions of the attendant will be just cause for the gate attendant to detain the permittee for police investigation.
