A.
Every food service establishment, which serves alcoholic
beverages, shall post and maintain on its premises a sign, which must
be at least 8 1/2 inches by 11 1/2 inches, in conspicuous
and prominent locations inside the facility, specifically at or adjacent
to all public entrances to such facility and or at the bar, if any.
These signs shall state one or more of the following:
B.
The operator of such a food service establishment
which fails to post or maintain these signs shall be chargeable with
a violation of this article and shall be subject to a fine or a civil
penalty.
For the purpose of this article, the definition
of a food service establishment shall be consistent with the definition
as stated in Part 14-1.20 of the New York State Sanitary Code. That
definition is as follows: "A food service establishment is a place
where food is prepared and intended for individual portion service
and includes the site at which the individual portions are provided
whether consumption occurs on or off the premises. The term excludes
food processing establishments, retail food stores, private homes
where food is prepared for family consumption and food service operations
where a distinct group mutually provides, prepares, serves and consumes
the food such as a 'covered dish supper' limited to a congregation,
club or fraternal organization."
Each sign shall be at least 8 1/2 inches
by 11 inches in size and shall contain lettering which is at least
1/2 inch in height. All letters shall be in sharp contrast to the
sign's background so as to be easily readable, as determined by the
Monroe County Health Department.
