The York County Drug Task Force is a special prosecution unit of the York County District Attorney's Office. It consists of special deputy prosecutors dedicated to drug enforcement prosecutions and a number of County Detectives who participate and assist in the investigations.
The Drug Task Force is in part funded under the forfeiture section of the Controlled Substance, Drug, Device and Cosmetic Act,[1] which allows the commonwealth to seize funds and other property used to facilitate drug transactions, the proceeds of which are subject to forfeiture for the use of the District Attorney. These funds are kept in a separate account which is the sole property of the District Attorney but which is administered through the Controller's Office.[2] The fund is to be used solely at the discretion and direction of the District Attorney and is not to be part of the general fund.
At the conclusion of every calendar year, the Controller conducts an audit of this account, which audit is then forwarded to the Attorney General for review by the House and Senate Judiciary Committees. Neither the audit information nor the Controller's records of the Drug Forfeiture Account are matters of public record. The District Attorney has, however, agreed to comply with county procedure as it relates to expenditures and expenses for purposes of recordkeeping.
