No person shall consume any alcoholic beverage nor possess or transport any open can, bottle or other container containing an alcoholic beverage on or in any of the following (unless application has been approved by the License Commission and a license has been issued for the sale and service of alcohol): City streets and sidewalks; all City parking lots and the E. John Gare III Parking Garage; playgrounds and playing fields, including but not limited to Sheldon Field, Maines Field, Arcanum Field, Veterans Field, and Agnes Fox Playground; park, including but not limited to Bridge Street Park, Trinity Row Park, Cosmian Park, Pulaski Park, and Kolodzinski Park; any area or facility under the control or supervision of the Recreation Commission or the Conservation Commission, including but not limited to the William Nagle Downtown Walkway, Fitzgerald Lake Conservation Area, Roberts Hill Conservation Area, Barrett Street Marsh, Rainbow Beach Conservation Area, and Musante Beach Recreation Area; school playgrounds and grounds, including parking areas and including schools not currently in active use as a school.
Alcoholic beverages are prohibited from being brought into or consumed at the Frank Newhall Look Memorial Park from November 1 through April 30, except upon premises licensed by the Northampton License Commission.

No person shall consume any alcoholic beverage nor possess or transport any open can, bottle, or other container containing alcohol on any street, sidewalk, parking lot, playgrounds, or public yard on property owned and/or managed by the Northampton Housing Authority (unless application has been approved by the License Commission and a license has been issued for the sale and service of alcohol); provided, however, that an area in use for a function sponsored by a tenant association or the Northampton Housing Authority and approved in advance by the Northampton Housing Authority shall be exempt from the operation of this section. For purposes of this section, a "public yard" shall be defined as any area farther than 15 feet from the front or back door of an apartment or apartment building where there is no fencing, porch, or property marker to clearly define a building's private yard.

The License Commission, by majority vote, may, upon written application, permit and issue a license for the public sale, use and/or possession of alcoholic beverages and the consumption thereof in any of the locations listed in § 120-1 and may impose such conditions on said sale, use and possession as it deems appropriate. The Recreation Commission in conjunction with the License Commission may, by majority vote, allow the public sale, use, and/or possession of alcoholic beverages and the consumption thereof in Sheldon Field, Maines Field, Arcanum Field, and Veterans Field, for a specific event or occasion, and may impose such conditions on said sale, use and possession as it deems appropriate.
