As used in this article, the following terms
shall have the meanings indicated:
Vehicles of the Fire Department and the Police Department,
ambulances and private and governmental emergency vehicles.
Every device propelled by human power upon which any person
may ride, having two tandem wheels, either of which is over 20 inches
in diameter. "Bicycle" includes pedal bicycles with helper motors
rated at less than one brake horsepower, transmitted by friction and
not by gear or chain, which bicycles produce only ordinary pedaling
speeds up to a maximum of 20 miles per hour.
Includes all motor vehicles used for the transportation of
passengers for hire, or used for the transportation of goods, wares
or merchandise, and/or all motor vehicles designed and used for drawing
other vehicles and not so constructed as to carry any load thereon
either independently or as any part of the weight of a vehicle or
load so drawn.
The weight equal to the weight of a vehicle without load,
plus the weight of its maximum load carrying capacity, as rated by
the manufacturer.
The maximum weight which may be carried by a truck, as disclosed
by the manufacturer's rating.
Every self-propelled device in, upon or by which any person
or property is or may be transported or drawn upon the land, including,
but not limited to, automobiles, motorcycles, scooters and trucks.
Any person who is in actual physical control of a motor vehicle.
Any person in whose name the legal title of a motor vehicle
is registered, or if such vehicle is the subject of a lease or conditional
sales agreement, the lessee or person with the right of purchase upon
performance of the conditions stated in the agreement and with the
immediate right of possession.
The standing of a motor vehicle upon the land attended or
unattended by an operator thereof.
An area of land near or contiguous to a shopping center and
used by the public as a means of access to and egress from the stores
and business establishments at the shopping center and for the free
parking of motor vehicles of patrons at the shopping center.
A privately owned and maintained road allowing access to
more than one residence or place of business, which road is normally
open to the public and upon which persons other than owners located
thereon may also travel.
Any piece of privately owned and maintained property which
is used for vehicular traffic but is not open or normally used by
the public.
Any way or right-of-way open to the public for vehicular
travel.
All platted subdivisions of land, except supervisors' plats
in which single-family dwellings are located, including any public
or private driveway, street, road or highway adjacent to or within
such a subdivision of land.
An area near or contiguous to buildings owned by a board
of education, school district or community college district and used
by the public as a means of access to and egress from such buildings
and for the free parking of motor vehicles of persons having business
within such buildings.
A minimum area of three acres of land on which there is located
one or more stores or business establishments and for which a parking
lot is provided.
That portion of a street between the curb lines or lateral
lines of a roadway and the adjacent property lines, intended for the
use of pedestrians.
Every motor vehicle designed, used or maintained primarily
for the transportation of property.
Subject to the provisions of Act No. 300 of
the Public Acts of 1949, as amended (MCLA Chapter 257, as amended),
the parking of a motor vehicle, the gross vehicle weight of which
exceeds 20,000 pounds, in a residential area, is prohibited.
A.
Speed limit. No person shall operate any motor vehicle
upon any portion of a shopping center parking lot, including, but
not limited to, the entrance and exit of such parking lot, at a greater
speed than that permitted by the then existing conditions for the
safety of persons and property, and in no event in excess of 15 miles
per hour.
B.
Parking. No person shall park a vehicle in any of
the following places at or within a shopping center parking lot, except
when necessary to avoid conflict with other traffic or in compliance
with law or the directions of a police officer or traffic control
device:
(1)
On a sidewalk;
(2)
Upon or across any entrance or exit to such parking
lot;
(3)
Upon or across any driveway or other passageway for
the movement of vehicular traffic on such parking lot;
(4)
Upon any portion of a fire route;
(5)
In any other area, except in those areas of a parking
lot which are striped and thereby identified for vehicle parking purposes;
or
(6)
In any parking space that is designated as being for
handicapped persons only. However, this prohibition shall not apply
to physically handicapped persons who possess material and capacity
for ambulation and have received from the Secretary of State a serially
numbered certificate of identification pursuant to Act No. 300 of
the Public Acts of 1949, as amended (MCLA Chapter 257, as amended).
C.
Bicycles. Bicycles shall be parked only in those areas
of a parking lot which are designated for bicycle parking purposes.
Bicycles shall not be ridden or operated upon sidewalks in the parking
areas used or identified for pedestrian traffic.
D.
Standing or stopping. The stopping or standing of
vehicles for the loading and unloading of goods or passengers, or
otherwise, except in the normal course of traffic flow, shall be prohibited
in the approximately thirty-foot service drive adjacent to and in
front of the shopping center stores.
A.
Application. The provisions of this chapter regulating
the traffic and parking of vehicles in school parking lots are applicable
only to such parking lots where the Board of Education, the School
District or the board of trustees of a community college owning the
same, has requested such regulations pursuant to Act No. 175 of the
Public Acts of 1958, as amended (MCLA 257.961, as amended).
B.
Speed limit. No person shall operate any motor vehicle
upon any portion of a school parking lot, including, but not limited
to, the entrance and exit of such parking lot, at a greater speed
than that permitted by the then existing conditions for the safety
of persons and property, and in no event in excess of 15 miles per
hour.
C.
Parking. No person shall park a motor vehicle in any
of the following places at or within a school parking lot except when
necessary to avoid conflict with other traffic or in compliance with
law or the directions of a police officer or traffic control device:
(1)
On a sidewalk;
(2)
Upon or across any entrance or exit to such parking
lot;

the movement of vehicular traffic on such parking lot;
(4)
Upon any portion of a fire route; or
(5)
In any parking space that is designated as being for
handicapped persons only. However, this prohibition shall not apply

D.
Additional regulations. In addition to the foregoing
provisions applicable to school parking lots, the following regulations
shall apply:
(1)
All motor vehicles shall park in accordance with posted
signs and/or within designated lined areas of any school parking lot.
(2)
No motor vehicle shall park on or across any entrance
or exit from a school building.
(3)
On any school parking lot that is not marked by appropriate
signs, all motor vehicles shall be parked in such a manner as not
to obstruct passageways, driveways, entrances or exits to the parking
lots or school buildings.
(4)
No motor vehicle shall be parked in any school parking
lot between 2:00 a.m. and 6:00 a.m. except when such motor vehicle
is parked in an area designated by posted notice as being for overnight
parking.
(5)
The provisions of this chapter relative to parking
are not applicable to School District properties where a charge or
fee is imposed by the School District for the use of its parking lot,
or in those instances where such charge or fee is imposed.
This chapter shall not be applicable to authorized
emergency vehicles, nor shall this chapter be applicable to commercial
vehicles loading or unloading goods, wares or merchandise for the
stores located in a shopping center when such loading or unloading
cannot be reasonably done in the parking areas to the rear of the
stores located in the shopping center.
In any proceeding for a violation of any parking
provision of this chapter, the person to whom a motor vehicle is registered,
as determined from the registration plate displayed on such motor
vehicle, shall be presumed in evidence to be the person who committed
the violation charged.

B.
Off-street parking at existing single-family residences
shall be permitted on a designated parking strip, parking bay, driveway,
garage or combination thereof. No parking shall be permitted on lawns
or other unpaved areas on residential lots, with the exception of
approved gravel parking areas, nor shall parking be permitted on or
across sidewalks. Paved or gravel area for parking shall not exceed
50% of the total area of the front yard.
C.
The storage of trailers, merchandise, unlicensed,
or inoperable motor vehicles or vehicles under repair is prohibited
in required off-street parking in residential areas, unless enclosed
in a garage or car port adjacent to or to the rear of the residential
structure.

A.
No person shall park, leave unattended or fail to
remove any motor vehicle or trailer on any pubic street, highway or
alleyway, or cause the same to remain parked, after a snowfall and/or
drifting snow of four inches or more prior to the removal by City
plowing of the street.
B.
All vehicles and/or trailers found to be in violation
of this section shall be ticketed and the owner, if possible, shall
be notified to remove such vehicle from the public street, highway
or alleyway at the expense of such vehicle owner. Such expense shall
include towing and storage charges attached to the vehicle.
C.
A person may obtain a hardship permit from the Police
Department by completing an application provided therefor and signing
an affidavit indicating that the residence does not have off-street
parking or that off-street parking is inadequate by reason of his
or her physical condition.
A violation of any provision of this chapter
shall be a misdemeanor, punishable as provided in Chapter 1, General
Provisions, Article II. See Chapter 156, Parking Violations Bureau.[1]
