Property which has an automatic-activated or manually operated lawn and landscaping water irrigation system which is connected to the municipal water system is restricted from watering or irrigating pursuant to the following restrictions between May 15 and October 15 of each calendar year:
A. 
Automatic lawn and/or landscaping irrigation is prohibited between the hours of 5:00 a.m. and 11:00 p.m. except as otherwise provided in Subsection E below.
B. 
Properties whose lawn and/or landscaping are manually watered utilizing a garden hose and sprinklers are prohibited from watering between the hours 5:00 a.m. and 9:00 a.m.
C. 
All properties with an even-numbered address shall be allowed to irrigate or water on even-numbered dates within the month.
D. 
All properties with an odd-numbered address shall be allowed to irrigate or water on the odd-numbered dates within the month.
E. 
An automatic, programmable underground irrigation system may occasionally be used in an unprogrammed mode for brief periods as necessary for testing, repair or new lawn or landscape installations. New lawns and landscaping may be watered automatically or manually for a period of 21 days following planting.
The City Council of the City of Rockwood may declare an emergency and require that lawns and landscaping sprinkling or irrigation, car washing and other similar uses of water outside of a building be limited entirely for such periods as it deems advisable in order to assure an adequate supply of water for domestic and industrial use. Such determination shall be based on drought conditions, depletion of water supply, reduction in water pressure, or other reasons suggested by the Detroit Water and Sewer Department or the Michigan Department of Environmental Quality.
A. 
The Director of the Department of Public Works (Director) shall cause such a declaration to be posted at the City hall and on the City website, announced over cable television, broadcasted from local radio and television with a range covering the City, and may cause the declaration to be further announced in newspapers of general circulation within the City when feasible.
B. 
It shall be unlawful for any person to utilize water from the City water supply system for any type of outdoor use in contravention of a declared water supply emergency, other than responding to a fire emergency. The prohibition shall remain in effect 24 hours a day, seven days a week, from the day it is announced until the water supply emergency is declared ended by the Director.
C. 
If the above-declared emergency creates a hardship for a large commercial or industrial water user or construction project, the water user can petition the Director asking for relief from one of the above-referenced restrictions. The petitioner shall set forth the requested relief and shall detail the extraordinary circumstances that would justify the requested relief as well as the duration of the requested relief. The decision of the Director can be appealed to the City Council.
A violation of any provision of § 254-44 of this article shall be a municipal civil infraction, punishable as provided in Chapter 1, General Provisions, Article II.
