A.
Engineering review fees.
(1)
Subdivisions and site condominiums.
(a)
Checking closure, lot areas: $500 plus $20 per
lot. (This amount to be deposited by the developer.)
(b)
Review and processing of grading utilities,
paving, storm sewers, sanitary sewers, water mains, retention basins
and pump stations: 1.0% of construction cost for projects. (This amount
to be deposited by the developer based upon the Engineer's estimate.)
(c)
Field check to assure monuments and property
irons are installed within one year of recording of the plat: to be
billed to the developer on a time basis in accordance with the then
Standard Rate Schedule as established by the City Engineers. (To be
deducted from escrow account established to insure irons and monuments
are installed.)
(d)
Full-time inspection of grading, utilities,
paving, sanitary sewers, storm sewers, water mains, detention basins,
pump stations and all other site improvements: Charges are based upon
hourly rate of the Standard Rate Schedule as established by the Engineer
and the City. This amount to be deposited by the developer, based
upon Engineer's estimate, shall be 6% of the first $100,000 of construction
cost, 4% of the next $100,000 of construction cost, and 3% of the
remaining construction costs of the improvements.
(2)
Apartment complexes and attached condominiums.
(a)
Site plan review for compliance with all ordinances
and standards: $500 plus $15 per unit or any part thereof. (This amount
to be deposited by the developer.)
(b)
Grading, paving, sanitary sewer, water mains
and storm sewers other than building leads: 1.0% of the construction
of each utility. (This amount to be deposited by the developer based
upon Engineer's estimate.)
(c)
Full-time inspection of the construction for
grading, paving, storm sewers, sanitary sewers, water mains, and other
utilities to be dedicated to the City: Charges are based upon hourly
rate of the Standard Rate Schedule as established by the Engineer
and the City. This amount to be deposited by the developer, based
upon Engineer's estimate, shall be 6% of the first $100,000 of construction
cost, 4% of the next $100,000 of construction cost, and 3% of the
remaining construction costs of the improvements.
(3)
Industrial and commercial developments.
(a)
Site plan review for compliance with all ordinances
and standards: $500 plus $25 per acre or any part thereof. (This amount
shall be deposited by the developer.)
(b)
Sanitary sewers, water mains, storm sewers,
grading, paving, and other site improvements: 1.0% of construction
cost of each site improvement. (This amount shall be deposited by

B.
Zoning fees.
(1)
Rezoning fee: Each petitioner requesting or petitioning
for rezoning under or by amendment to the City of Rockwood Zoning
Ordinance shall at the time of filing such petition pay to the City
of Rockwood the following nonrefundable rezoning filing fee or charge
as a condition of and prior to the City's administrative processing
of such petitions for rezoning or amendment:
(a)
All districts, except as provided in 1(B): a
minimum charge of $500 which shall include the first five acres or
less petitioned to be rezoned plus a planning consultant fee of $450
and, thereafter, $10 per acre for each additional acre or portion
thereof included in such petition for rezoning.
(b)
Owner-occupied individual single-family or two-family
dwelling units: $100 for petitions to rezone single lots to residential
zones.
(2)
Zoning Board of Appeals fee. Each person filing an
appeal with the City of Rockwood Zoning Board of Appeals and Adjustments
shall at the time of filing its appeal pay to the Secretary of the
Board of Appeals the following nonrefundable fee or charge as a condition
of and prior to the City's administrative processing of such appeal
by the Zoning Board of Appeals and Adjustments:
(a)
For any appeal involving residentially zoned
property: $100.
(b)
For any appeal involving commercially zoned
property, except for individual single-family or two-family dwelling
units within a commercial zone, which shall be required to pay the
fee in Subsection B(1): $250.
(c)
For any appeal involving industrially zoned
property, except for individual single-family or two-family dwelling
units within an industrial zone, which shall be required to pay the
fee in Subsection B(1): $300.
(d)
For a petition for use variance review in any
zoning classification: $450
(3)
Lot splitting fee. Each person requesting or petitioning
the City of Rockwood for approval of a lot split shall, at the time
of filing its petition or request, pay to the City of Rockwood the
following nonrefundable lot split fee or charge as a condition of
and prior to the City's administrative processing of such petition
for lot splitting: $200 plus $20 per lot resulting.
(4)
Site plan review fees. Each person requesting a site
plan review as provided for and required under the zoning and other
ordinances of the City of Rockwood shall at the time that that such
site plan review is requested pay to the City of Rockwood the following
nonrefundable site plan review fees or charges as condition of and
prior to such site plan review procedures being instituted by the
City:
(a)
Multiple family (R-B and R-C Districts): $400
plus $6 per dwelling unit. For each submission of a revised site plan,
60% of the original fee shall be charged.
(b)
Commercial and industrial development (M-1,
M-2, PF-1, CM-1, B-1, B-2, B-3, O-1, O-R and F-S Districts): $475
plus $50 per acre or fraction thereof. For each submission of a revised
site plan, 60% of the original fee shall be charged.
(c)
Mobile home park: $600 plus $6 per site. For
each submission of a revised site plan, 60% of the original fee shall
be charged.
(d)
Planned unit development (PUD): $500 plus $50
per acre for any nonresidential area plus $6 per dwelling unit for
any residential component. For each submission of a revised site plan,
60% of the original fee shall be charged.
(e)
Other use (office/institutional): $425 plus
$50 per acre or fraction thereof. For each submission of a revised
site plan, 60% of the original fee shall be charged.
(g)
Subdivision site plans or site condominiums:
the same fee as D(6)(a) above. Each revision of plans shall be accompanied
by a fee equal to 60% of the original fee charged.
(5)
Special approval or conditional use (all districts):
$250 in addition to site plan review fee.
(6)
Application to schedule special meeting (A special
meeting is any meeting not held at a regularly scheduled date.):
(7)
Special City Planner, City Attorney and City Engineer
costs. Conferences, meetings or field inspections by City consultant(s)
(City Planner, City Attorney, or City Engineer) as requested by the
applicant or required by the City shall be the actual costs incurred
for consultants, planner or attorney. Such charges shall apply to
any special meeting, special review or special service requested by
the applicant or required by the City as part of the review process
for any of the applications covered by the above fee schedule.
(8)
Waiver provision. The fees established by this resolution
may be waived upon a determination by the City Council that a hardship
exists.

require a cash bond or surety bond for each building permit for performance
of cleaning up after a job has been completed. Said bond shall be

Cancellation and refund: Upon written request
by the permit holder, prior to commencement of any work, a permit
may be canceled and the permit fee refunded. A fee of $15 will be
retained by the City to defer administrative expenses. Review fees

Water rates.
(1)
Meter charges. A meter charge shall be paid
each quarter by each user of water from the City water system, according

(2)
Rates inside City. The following rates shall
apply in the City to all users of water from the City's water system.
(a)
Wholesale users. Wholesale users shall pay a
charge determined in each case by Council.
(b)
Other than wholesale users. Users other than
wholesale users shall pay a rate or charge of $1.46 per 1,000 gallons
or fraction thereof of water used in each quarter. Users of over 750,000
gallons in a quarter shall pay a charge or rate of $0.97 per 1,000
gallons or fraction thereof of water used in the quarter, or shall
pay for such quarterly water usage at the prevailing wholesale rate.
(c)
Minimum rate. All bills shall be subject to
a minimum rate of $5.35 per quarter for water used in the quarter,
except that the minimum charge shall not apply to users who:

Are citizens of the City and reside within the
City limits;
[2]
Are 65 years of age or older;
[3]
Quality for a senior citizens real property
tax exemption under the laws of the state;
[4]
Use water supplied to them by the City for their
own personal residential use and consumption, and for the personal
residential use and consumption of their spouse, children and others
residing with them, to such an extent that they qualify as dependents
under federal income tax laws; and
[5]
Are liable for payment of water service supplied
to their place of residence.
Such five qualifications must coexist in time
with respect to a user in order to qualify the user for a minimum
charge exemption.

(3)
Rates outside City. Users of water from the
City water system who are outside the City shall pay a rate of $2.50
per 1,000 gallons or fraction thereof of water used in each quarter.
B.
Sewer rates. The following charges for sewage disposal
service shall be levied upon all premises having any sewer connection
with the public sewers:
(1)
Rates inside City. The following rates shall
apply within the City to all users of the City's public sanitary sewers
for the discharge by such users of sewage into the City's sanitary
sewers:
(a)
Wholesale users. Wholesale users shall pay a
charge determined in each case by Council.
(b)
Other than wholesale users. Users other than
wholesale users shall pay for the treatment of sewage discharged by
such users into the City's sanitary sewer a rate or charge of $2.55
per quarter per 1,000 gallons or fraction thereof of water used by
such user in each quarter.
(2)
Industrial surcharge rate. Where it is determined
that the character of sewage from any manufacturing or industrial
plant, building or premises in the City is such that it imposes an
unreasonable additional burden upon the City's sewerage system, and
that the services necessary to treat such sewage are above that imposed
by the average sewage being treated, such manufacturing or industrial
plant, building or premises shall, in addition to the rates established
for sewage treatment as provided for in this chapter, pay an additional
quarterly sewage treatment surcharge, as established by Council in
each case, for such additional services necessary to treat such sewage
discharge.
C.
Replacement charge. In addition the rates set forth
in Subsection B(1) and (2), a replacement charge of $8.35 per unit
basis (see § 254-7 of Chapter 254 of the Code of the City
of Rockwood) per month shall be charged to all users of the City's
public sanitary sewer to fund the capital costs of upgrading and maintaining

Debt charge. A debt charge of $9.10 per unit basis

per month shall be charged to all users of the City's public sanitary
