Due to the limited number of Village docks available
for use by residents and transients and due to increased use of said
docks, the Board of Trustees of the Village of Clayton has found it
necessary to regulate the use of the various Village docks in order
to determine a fair and equitable use by all persons involved.

Docking at the Village of Clayton docks on the northerly side of Riverside Drive in the general area between Merrick Street and Mary Street shall be limited to three consecutive hours between 8:00 a.m. and 8:00 p.m. each day. Open docking shall be allowed from 8:00 p.m. until 2:00 a.m. Fees shall be established in accordance with § 58-6.

Docking at the Village of Clayton dock at the
southwest end of Mary Street shall be available for boaters between
the hours of 8:00 a.m. and 8:00 p.m. each day and shall be limited
to three consecutive hours. Overnight docking is available from 8:00
p.m. to 8:00 a.m. Twenty-four-hour docking is permitted only if the
fee is prepaid and is limited to no more than three continuous days.
All dockage will be subject to the control of the Dock Master. The
dock will be reserved for use by the Antique Boat Museum for the purpose
of its Annual Antique Boat Show on such dates and times as are set
by the Board of Trustees by resolution yearly.

The launching ramp at the southwest end of Mary Street shall be available for use by the public. Fees shall be established in accordance with § 58-6.

A.
Any person violating any provision of this chapter
shall be subject to a fine of not more than $250 or imprisonment for
a term of not more than 15 days, or both.
B.
This chapter shall be enforced by the Village Dock
Master who shall be appointed by the Village Board on an annual basis.
In accordance with Municipal Home Rule Law § 10, Subdivision
4(a), and Criminal Procedure Law § 150.20, Subdivision 3,
the Village Dock Master shall also have the power to issue and serve
appearance tickets in connection with the performance of his duties
in enforcing any statute, local law, ordinance, rule or regulation
relating to the dockage and launching of boats, as well as refuse
and garbage disposal at those facilities.
C.
The issuance and service of appearance tickets by
the Village Dock Master shall have the same force and effect as if
served by a peace officer. Appearance tickets shall be of a form and
content acceptable under and shall be issued in accordance with Article
150 of the Criminal Procedure Law of the State of New York and may
be placed upon each boat found in violation or delivered to the violator
in person. Any boat left at the dock for more than two days after
the issuance of a uniform traffic ticket shall be towed therefrom
and stored at the owner's expense.
