Editor's Note: This local law was passed at referendum 3-20-1990. It was also originally adopted as Ch. 29 of the Code, but was redesignated as Ch. 76 to maintain the alphabetical sequence of the Code.
This chapter shall be known and cited as the "Games of Chance Law of the Village of Clayton."
As used in this chapter, all words shall have the same meanings as those defined in § 186 of the General Municipal Law and Title 9 of the New York Code of Rules and Regulations, Section 5600.1.
Authorized organizations may, upon obtaining a license from the Village Clerk, conduct games of chance within the Village of Clayton as provided in Article 9-A of the General Municipal Law, the Rules and Regulations of the New York State Racing and Wagering Board and as provided further in this chapter.
The conduct of games of chance shall be subject to the restrictions imposed by Article 9-A of the General Municipal Law and the Rules and Regulations of the New York State Racing and Wagering Board.
Games of chance may be conducted on Sundays between the hours of 12:00 noon and 12:00 midnight only, unless the following day is a legal holiday. Notwithstanding the foregoing provisions of this section, no games of chance shall be conducted on Easter Sunday, Christmas Day or New Year's Eve Day.
The Chief of Police of the Village of Clayton shall exercise control and supervision over all games of chance conducted under duly authorized license. The Chief of Police shall have all the powers and duties set forth in Article 9-A of the General Municipal Law.
