No person shall engage in the business of receiving, collecting, transporting or disposing of garbage, rubbish, trash or other wastes for hire within the Village of Clayton without first obtaining a license effective upon adoption of this chapter, the fee for which shall be $150 per year, with such fee modified annually by the Board resolution, if appropriate.
Applications shall be upon forms supplied by the Village Clerk. At the time of making such application, the applicant must furnish to the Clerk a schedule of intended pickup days on the various highways, streets and roads within the Village of Clayton, the schedule of rates and charges to be paid by the respective residential customers, along with a list of vehicles to be used by the applicant and the license numbers thereof.
Every license issued by the Village Clerk pursuant to this Article shall be subject to the following conditions and to such other reasonable conditions as may be imposed by the Village Board from time to time:
A. 
Vehicles used by licensed refuse collectors in the collection and transportation of garbage or rubbish or any other kind of waste within the Village of Clayton shall be enclosed, watertight and compacted units, except vehicles used for collection of trash.
B. 
The vehicles used by collectors and the routes of collecting shall be subject to inspection and reasonable visitation by the Village Board and its agents.
C. 
The licensee shall be required to carry a copy of his license in each truck used in the operation, showing payment of the license fee.
D. 
Term of license; fee.
(1) 
All licenses issued hereunder shall be valid for a period of 12 months, expiring May 31 of each calendar year after the date of issuance. Each licensee shall pay such annual license fee due on June 1 of each year.
(2) 
In the event that equipment is being used subsequent to September 1 of each year, 3/4 of the initial fee shall be payable, and in the event that the equipment is used subsequent to December 1 of each year, the licensee shall pay 1/2 of the initial license fee.
E. 
Revocation.
(1) 
Violations of any of the foregoing regulations or any other provisions of this chapter shall be cause for revocation of the license of any person to whom a license has been issued.
(2) 
The Village Board, notwithstanding anything to the contrary herein contained, shall have the power to revoke any license heretofore issued for cause shown, after a hearing before said Board, upon five days' written notice specifying the alleged violation to the license holder, given by certified mail and directed to his principal office at the address filed with the Village Clerk with the licensee's application.
F. 
All trucks must have a minimum liability insurance for personal injury of $500,000 per occurrence and $500,000 per annual aggregate, naming the Village of Clayton as an additional insured.
G. 
No collector shall cease or discontinue business in the Village of Clayton unless 30 days' prior written notice has been given to the Village Board, together with proof of publication in the Thousand Islands Sun and of said notice to all customers serviced within said Village.
A license may be refused if the applicant, in the judgment of the Village Clerk, should fail to meet and/or demonstrate the ability to meet the requirements of this chapter. Any applicant who has been refused a license by the Village Clerk may appeal to the Village Board, and from such refusal such license may be granted or refused by the Village Board.
The refuse collector must give 30 days' prior written notice to the Village Board of any change in rates, specifying the amounts thereof, before the same becomes applicable.
The refuse collectors shall not permit refuse to fall or collect upon the highway, roadway, street or ground from which they are collecting or over which route they are traveling, nor shall they permit refuse to set out or to fall from any vehicle or in any way become distributed upon or along private property or on the public highways, roadways or streets or thoroughfares.
