This chapter shall be known and may be cited as the "Village of Clayton, New York, Zoning Law."
It is the intent of this chapter to promote the public health, safety, morals and general welfare of the community and the other purposes contained herein and also to accomplish the following: to maintain the small-town atmosphere of the Village; to encourage and promote the tourism industry; encourage and promote the recreational and commercial use of the Village's riverfront; to promote the design and use of land and buildings to maintain the integrity of existing residential and commercial neighborhoods; to encourage small manufacturing operations where appropriate; to promote and implement the policies of the Village's Local Waterfront Revitalization Program; to reduce the potential for public safety hazards and property damage from periodic flooding in those areas designated by the Federal Emergency Management Agency as flood hazard areas; and to provide maximum practical preservation of natural and environmental features, including water bodies, wetlands and other areas of geographical, ecological and scenic value.
Hereafter no building shall be erected, moved or altered and no land shall be used except in conformity with the regulations specified for the district in which it is located.
No building shall hereafter be erected or altered to accommodate or house a greater number of families or to have narrower or smaller rear yards, front yards, side yards, inner or outer courts than is specified herein for the district in which such building is located. No part of a yard or other open space about any building required for the purpose of complying with the provisions of this chapter shall be included as part of a yard or other open space similarly required for another building.
Within each district the regulations established by this chapter shall be minimum regulations and shall be applied uniformly to each class or kind of structure or land.
For purposes of interpretation and application, the provisions of this chapter shall be held to be minimum requirements adopted for the promotion of the public health, morals, safety or the general welfare. Whenever the requirements of this chapter are at variance with the requirements of any other lawfully adopted rule, regulation or law, the more restrictive or that imposing the higher standard shall govern.
Where a district boundary line divides a lot in single or joint ownership existing at the time of enactment of this chapter the regulations pertaining to each district will govern the use of land within that district.
All premises within the Village of Clayton whether improved, unimproved, or vacant shall be maintained in conformity with the provisions of the New York State Uniform Fire Prevention and Building Code[1] and the NYS Property Maintenance Code so as to assure the proper character of the property and to promote the health, safety and general welfare of the public.

The provisions of this chapter shall be considered the minimum requirements for the promotion of the public health, safety, and general welfare. It is not intended by this chapter to interfere with or abrogate or annul any easement, covenant, or other agreement between parties; provided, however, that when this chapter imposes a greater restriction on the use of structures or land or on the heights of structures, or requires larger open spaces, or imposes any higher standards than are imposed or required by any easement, covenant, or agreement, the provisions of this chapter shall control. Where the requirements of this chapter differ from the requirements of another statute, law, rule, or regulation, the more restrictive standard shall govern, unless this chapter specifically states otherwise.
