As used in this article, the following terms
shall have the meanings indicated:
Includes all containers normally used in the consumption
of alcoholic and nonalcoholic beverages, both in the home and in retail
establishments dispensing the same for on- or off-premises consumption,
the same being made entirely of aluminum.
Aluminum and tin or tin-plated steel food and beverage containers,
including those for fruits, vegetables, juices and pet food.
All places of business (wholesale, retail, service, food,
transportation, etc.).
Clear, green and brown glass bottles and jars, aluminum,
steel and tin cans, plastic containers with a number within the recycling
symbol located on the container.
Computers, monitors, keyboards, wires/cables, telephones,
TVs, VCRs, DVD players, stereos and microwaves.
Is scrap metal that is magnetic and rusts, such as structural
steel or cast-iron components.
All containers and objects commonly used in residential and
nonresidential premises, such as bottles, jars, glasses, jugs and
all other vessels made entirely and exclusively of glass.
All government buildings (schools, colleges, hospitals, clinics,
etc.).
Are the types that contain lead and lead oxide with the sulfuric
acid electrolyte produces a voltage.
Foliage material naturally formed from trees and bushes that
are suitable for composting and mulching.
Includes white goods (refrigerators, washers/dryers) and
ferrous metals.
A combination of paper products found in an office environment.
Typically, it means high-grade papers such as copier paper, computer
printout and stationery. It also includes magazines, catalogs, brochures,
white envelopes, advertising flyers and most mail.
Newspaper (including inserts), mixed paper (mail, magazines,
office, colored and computer paper, regular and window envelopes),
cardboard. Material should be clean, not contaminated by food or pet
waste.
Any building or structure, or complex of buildings in which
three or more dwelling units are owner-occupied or rented or leased,
or offered for rental or lease, for residential purposes (see N.J.S.A.
13:1E-99.13a), and shall include hotels, motels, or other guesthouses
serving transient or seasonal guests, as those terms are defined under
Subsection (j) of Section 3 of the "Hotel and Multiple Dwelling Law,"
P.L. 1967, c. 76 (N.J.S.A. 55:13A-1 et seq.).
Paper of the type commonly referred to as "newsprint" and
distributed at stated intervals, usually daily or weekly, having printed
thereon news and opinions and containing advertisements and other
matter of public interest.
All corrugated cardboard of the type commonly used for boxes,
shipping containers and packing material, having exterior cardboard
plies separated by air spaces created by one or more fabricated cardboard
plies.
Only those containers, such as beverage containers and laundry
product containers, that have the resin identification code "01" (PET)
or "02" (HDEP).
An employee designated by the Mayor and Council to carry
out the Township's recycling program.
All homes, condominiums, townhouses, apartments, trailer
parks, etc.
Includes all garbage and rubbish normally placed at the curb
by the residents and other occupants of the Township of Bloomfield
for regular collection, but shall exclude all items which the Township
shall determine are recyclable.
Any waste crank case oil from periodic maintenance of internal
combustion engines.
Appliances such as refrigerators, air conditioners, stoves,
washers, dryers, steel or cast-iron plumbing fixtures, dishwashers
and water heaters.

Prior to March 1 of each year, occupants of
all commercial and institutional establishments, multifamily housing
owners or their agents shall report, on forms provided by the municipality,
to the Municipal Recycling Coordinator, the tonnage of recyclables
collected and removed from the municipality during the previous year.

There is hereby established a program for the
mandatory source separation from the municipal solid waste stream
by the single-family and multifamily residential, commercial, office
park, industrial, institutional and governmental solid waste generators
of the Township at the point of generation of the following items:

Also, such other recyclable materials to be added or deleted
as designated recyclables by the County of Essex pursuant to a duly
adopted amendment to the County Solid Waste Management Plan approved
by the New Jersey Department of Environmental Protection.

Commingled and mixed paper and leaves shall
be kept separate from and not mixed with regular refuse which is collected
separately. Persons may wrap solid waste in newspaper and discard
the same with regular solid waste even if such wrapping does render
the newspaper unusable for recycling.
A.
Leaves shall be placed in biodegradable bags only
along the curbside of the street. During the period of April 1 through
May 15 and October 1 through December 31 of each year, leaves shall
be placed in biodegradable bags only along curbside. Landscapers are
required to conform in all respects to these requirements.
B.
Newspaper and mixed paper.
C.
Grass clippings and other yard waste. No grass clippings,
brush, branches, yard takings or other vegetative matter shall be
placed loose or in piles on the sidewalk, gutters or streets of the
Township of Bloomfield. All such matter shall be separated from all
other matter and placed in biodegradable bags not weighing more than
50 pounds or tied in bundles not longer than four feet in length and
not weighing more than 50 pounds for the collection by the Township.
Landscapers are required to conform in all respects to these requirements.
D.
Electronics items shall be kept separate from and
not mixed with regular refuse. Electronics items shall be taken to
the Department of Public Works and Park Maintenance garage for disposal.
E.
Metal items shall be kept separate from regular refuse.
Call Public Works for schedule pick up.
F.
Used motor oil shall be kept separate from regular
refuse and taken to the county household hazardous waste days.
G.
Lead acid batteries shall be disposed of by taking
batteries to the county household hazardous waste days.
A.
The Township Administrator is hereby authorized and
directed to negotiate and to enter into contracts to dispose of all
used recyclables collected by the Township as herein described or
to place same out to bid if required by the Local Public Contracts
Law.[1] The Township may utilize its own personnel to collect
such recyclables or may contract out the cost of collection.

B.
Anything herein to the contrary notwithstanding, any
person may donate or sell recyclables to any person, whether operating
for profit or not for profit. It shall be further permissible under
the terms of this section for any person to obtain a permit from the
Township of Bloomfield to collect recyclables within the Township.
Any person obtaining such a permit shall not pick up recyclables from
the curb without specific permission to do so.
C.
It shall be a violation of this chapter for any person
unauthorized by the Township to collect or pick up or cause to be
picked up or collected such recyclables. Any and each collection in
violation hereof from one or more residences shall constitute a separate
and distinct offense punishable as hereinafter provided.

A.
Any person, firm or organization found guilty of who violating a
provision of this chapter shall, upon conviction, forfeit and pay
a fine of $75 for the first offense, $150 for the second offense and,
for the third and any subsequent offenses, shall be subject to one
or more of the following: a minimum fine of $250 but not exceeding
$1,250, a term of imprisonment not exceeding 90 days or a period of
community service not exceeding 90 days. In addition to the foregoing
penalties, where a container includes designated recycling material
mixed with solid waste, the container will not be collected.
B.
Fines levied and collected pursuant to the provisions of this chapter
shall be immediately deposited into the Municipal Recycling Trust
Fund (or equivalent).

A.
Membership.
(1)
There is hereby established a Recycling Committee
in the Township of Bloomfield, which membership shall consist of the
following:
(a)
The Recycling Coordinator who shall be appointed
by the Mayor and Township Council.
(b)
A member of the Township Council who shall be
appointed by the Mayor.
(c)
Seven members who shall reside in the Township
of Bloomfield and shall be appointed by the Mayor and Council.

(d)
One member of the Board of Education appointed
by the Board of Education.
(e)
One alternate member, who shall reside in the Township of Bloomfield
and shall be appointed by the Mayor and Council. The alternate member
shall be authorized to vote in the absence of a voting member.

(2)
The Recycling Coordinator shall serve at the pleasure of the Mayor
and Council; the member of the Council shall serve for a one-year
term. Initially, three voting members shall be appointed to one-year
terms, and two at-large members shall be appointed for two-year terms.
Thereafter, the terms of all voting members shall be for two years.
The alternate member shall be appointed for a two-year term. Three
members shall constitute a quorum.

B.
The Recycling Committee is hereby authorized and directed
to establish and promulgate, subject to approval by the Township Council,
reasonable regulations as to the selection and designation of recyclable
materials to be source-separated in accordance with the article, state
law and any applicable district recycling plan and to establish the
manner, methods and minimum standards for the collection and disposition
of designated recyclable materials in accordance with the provisions
thereof. Such regulations as may be promulgated under this article
may be changed, modified, amended or repealed by the Recycling Committee,
subject to the approval of the Township Council.
C.
The Recycling Committee shall make reasonable efforts
to publicize its regulations and to keep the public informed about
all possibilities to participate in the recycling effort. The Recycling
Committee shall at its sole discretion expend all funds associated
with the promotion and education component of the Township's recycling
program.
D.
The Recycling Committee, through the Recycling Coordinator,
shall report quarterly to the Township Council on the status of the
recycling program, provide a summary of the recycling activity of
the past year, and project the recycling operations planned for the
coming year.
