In any case where a provision of any Board of
Health ordinance is found to be in conflict with the provisions of
any zoning, building, fire, safety or health ordinance or code of
the Township, the provision which establishes the higher standard
for the promotion and protection of the health and safety of the people
shall prevail.
[Amended at time of adoption of Code (see Ch. 575, General
Provisions, Board of Health, Art. V)]
Except as otherwise provided, any person, firm
or corporation violating any Board of Health ordinance shall, upon

offense; not less than $250 for each second offense; and $500 for
each offense thereafter, or be subject to a civil penalty, not to
exceed $500, which penalty shall be enforced or collected through
any court of competent jurisdiction in accordance with the Penalty
Enforcement Law, N.J.S.A. 2A:58-10 et seq. Each violation of any Board
of Health ordinance and each day or part thereof the same is violated
shall be deemed and taken to be a separate and distinct offense.
The provisions of this chapter shall apply to
each ordinance of the Bloomfield Board of Health except for those
ordinances where a separate and distinct penalty is stipulated.
