Editor's Note: This ordinance repealed former Art. II, Parks Under Supervision of Department of Parks, Recreation and Public Lands, adopted 11-27-1973 by Ord. No. 1378 as Ch. 107, Art. I, of the 1973 Code, amended in its entirety 4-9-1974 by Ord. No. 1412, and subsequently amended.
A. 
The use of all Toms River Township parks and playgrounds, except for those with area lighting, is limited to daylight hours, except by special written permission for tent camping purposes only. Camping permits may be obtained at the Toms River Township Recreation Office.
B. 
Fires are permitted in park stoves only. Only charcoal may be used for fuel. Fires must be extinguished upon leaving the area.
C. 
No firearms, air guns, slingshots, bows and arrows, hunting knives, hatchets, axes or any other type of dangerous weapon shall be permitted on any park or playground premises at any time. The only exception to the above rule would be a strictly supervised program directed by the Recreation Department.
D. 
Removal of, damage to or destruction of shrubbery, trees, flowers, fencing, buildings or other properties is prohibited.
E. 
The possession of any narcotic is prohibited in any and all parks, recreation areas, parking lots and other areas owned by the Township and adjacent to said parks.
F. 
No dogs, except Seeing Eye dogs and dogs on a leash controlled by a person, shall be allowed.
G. 
Use of loud, profane or indecent language is prohibited.

H. 
Sale of food and beverage.
(1) 
Beer is permitted for consumption only, not resale, in designated group picnic areas in Riverwood Park, Winding River Park or Bey Lea Park. A permit for the use of said areas shall be obtained only through the Director of the Department of Recreation.
(2) 
Athletic events. Food or beverage may be sold only by nonprofit organizations of the Township before, during and immediately after the athletic event which shall be sponsored by said nonprofit organization, and all proceeds derived from said sales shall be the property of said nonprofit organization. The sale of food or beverage shall be subject to Board of Health regulations. No mobile vendors shall be allowed to sell food or beverage at said athletic event. A permit for the sale of food or beverage at an athletic event by nonprofit organizations shall be obtained from the Director of the Department of Recreation prior to the commencement of any and all such sales.
(3) 
Special events. Food, beverage and wares may be sold only at special events sponsored by nonprofit organizations of the Township. No alcoholic beverages may be sold at these events. Nonprofit organizations may use the services of "for profit" sellers to assist them in the sale of these items at their events and may share the profits with such persons or firms. The sale of food or beverage shall be subject to Board of Health regulations. No mobile vendors shall be allowed to sell food or beverage at said special events. A permit for the sale of food, beverage and wares at a special event by a nonprofit organization shall be obtained from the Director of the Department Recreation. The fee for the special event permit shall be $50.
I. 
Horseback riding is restricted to the designated bridle trails in the parks only. No galloping or racing is permitted on the bridle trails. Riding in other areas of the parks is prohibited.
J. 
Bicycles, nonmotorized, are restricted to bike trails only. No activity which may endanger the rider or park users will be tolerated.
K. 
Hiking trails are restricted to hikers only. No bikes, horses or motorized vehicles, except for maintenance purposes, are permitted on the trails.
L. 
All permits issued for camping, group picnic areas, beer use, etc., must be readily available for inspection by Recreation Department employees.
M. 
No swimming or diving from bridges or bulkheads is permitted in any park in the Township. Swimming is permitted only in designated areas.
N. 
No motorized vehicle or motorized bicycle, moped, etc., is permitted on designated bikeways.
O. 
No vehicle, motorcycle, moped or any other motorized vehicle shall be driven or parked in areas not specifically designated as a parking area.
P. 
No loitering or littering in any park or recreation area in the Township is permitted.
Q. 
The taking off and landing of all flying vehicles, whether motorized or without motors, including but not limited to ultralight aircraft, paragliders, parasails, parachute-type mechanisms and other man- or machine-powered apparatus, is prohibited in all Township parks and public lands. This shall not apply to helicopters which are engaged in emergency medical transportation or which have the permission of the appropriate Township officials to land on Township property.
R. 
For-profit enterprises may not use public facilities except through lessons provided by the Township.
S. 
The Director of Recreation may establish additional rules and regulations for the protection of the public and Township property as needed.
T. 
Any group of organized people, league, or organization which wishes to use any Township field must obtain a permit from the Department of Recreation and provide such when requested.
U. 
Tennis courts.

(1) 
Use of tennis courts is governed by the Toms River Township Council with the administrative oversight of the Department of Recreation.
(2) 
Organized groups may apply to the Department of Recreation for a facility use permit with the following requirements:
(a) 
Certificate of liability insurance naming Toms River Township as additionally insured.
(b) 
A fee of $5 per court, per hour.
(3) 
The maximum amount of courts that may be reserved at one time at the Bey Lea Tennis complex shall be eight courts, unless specifically authorized otherwise by the Director of Recreation.
(4) 
No organized group shall receive a facility use permit for use of Bey Lea Tennis courts for more than two tournaments per month.
A. 
Any person convicted of a violation of the said rules and regulations shall be subject to a fine not exceeding $2,000 or imprisonment in the county jail of Ocean County for a period not exceeding 90 days, or both.
B. 
Any person guilty of continued or repeated violation of the said rules and regulations shall be subject to removal and/or suspension of privileges of the use of the park or playground facilities.

A. 
Winding River Ice Rink fees.

(1) 
The Director of Recreation is hereby authorized to annually establish general admission, equipment rental, identification card, lesson and activity, program, rink rental, tournament, and other fees for the use of the Winding River Ice Rink facilities. All fees established pursuant to this provision, and any increases or reductions thereto, must be approved by the Business Administrator, the Chief Financial Officer, and by resolution of the Township Council.
(2) 
Proshop merchandise shall be offered for sale at the manufacturers' suggested retail price (MSRP) for particular items.
B. 
Other facilities and programs. The Director of Recreation is hereby authorized to annually establish fees for use of and for public and private activities, programs, and events held at Township parks, sports fields, and other recreational facilities. All fees established pursuant to this provision, and any increases or reductions thereto, must be approved by the Business Administrator, the Chief Financial Officer, and by resolution of the Township Council.
