A. 
Smoking, as defined in § 433-1, is hereby prohibited at both North and South Beaches of Ortley Beach, Shelter Cove Beach and the Municipal Swimming Pool, except in designated smoking areas as noted in § 433-6B.
B. 
Designated smoking areas, where smoking is permitted, are hereby established at the following locations:
(1) 
The North Beach: 50 feet north off 5th Avenue.
(2) 
The South Beach: 50 feet south off 7th Avenue.
(3) 
Shelter Cove Beach: the northerly 50 feet of that beach.

Smoking, as defined in § 433-1, is also prohibited in Shelter Cove Park and Castle Park when youth recreational-sponsored activities are taking place, and at all times in the Veterans Softball Complex.
There shall be posted at the entrance to the North and South Beaches of Ortley Beach, the entrance to Shelter Cove Beach, the entrance to the Municipal Swimming Pool, the entrance to Shelter Cove Park and at Castle Park conspicuous signs clearly stating that smoking is prohibited in these areas, either by a sign indicating "No Smoking" or by the international "No Smoking" symbol.
Smoking, as defined in § 433-1, shall also be prohibited within 100 feet of all playground equipment intended for use by children in all of the parks and recreation areas of the Township of Toms River.
A. 
Any person who violates any provisions of this article shall be subject to a fine not to exceed $100 for the first offense and to a fine not to exceed $200 as well as community service for subsequent offenses.
B. 
Each day of noncompliance shall constitute a separate infraction and punishable offense.
C. 
The Toms River Township Municipal Court shall have jurisdiction to hear complaints of violations of this article.
