GENERAL REFERENCES
Salaries and compensation — See Ch. 147.
All officials and employees of the Board of
Health shall be governed by each provision of this chapter unless
otherwise provided by law or by collective bargaining, union or private
agreements. In any event, any section which is not otherwise subject
to law or such agreement shall apply to all such officials and employees.
Some of the persons not included within the meaning of the terms "officials"
and "employees" are the Board's members, medical advisor, consulting
engineer, attorney or legal advisor, and the members of the Board
of Plumbing Examiners.
A.
Each official and employee of the Board of Health
is hereby classified and designated as within the salary guide set
forth in this chapter.
B.
The Board of Health does hereby adopt, for the purposes
of this chapter, the following salary guide, retroactive to January
1, 1977, establishing the salary grades, minimums, number and amount
of anniversary increments which may accrue to any official or employee
in the designated salary grade:

C.
The increases in any wage or salary provided herein
over and above the wages and salaries presently paid shall become
effective as of January 1, 1977.

D.
All officials and employees of the Board of Health
shall be paid biweekly.
E.
The annual increment as set forth in the said salary
guide is based upon the date of employment of each affected employee.
A.
At least once each year, on or about April 1 or when
the Board of Health shall determine to promote any official or employee
thereof, the Board of Health shall certify to the Township Treasurer
(with a copy to the Township Clerk for insertion in the personnel
record of such employee) all individuals and/or their titles and/or
positions, salary grades and steps and annual salaries and wages,
together with any increments, for all officials and employees of the
Board of Health subject to the provisions of this chapter. Said certification
shall be on file in the office of the Board of Health for public inspection.
B.
The Board of Health shall ratify and approve the aforesaid
certification by adopting a resolution with the certification attached
thereto and made a part thereof. Said resolution will be adopted only
after a public hearing, for which public notice was given. Within
10 days after adoption, the said resolution together with its attachment
shall be published in a newspaper of general circulation within the
municipality; and, thereafter, following publication, the aforesaid
resolution together with its attachment shall be incorporated by reference
in this chapter. The aforesaid resolution together with its attachment
shall be filed in the office of the Board of Health.
C.
No increases in wages and salaries shall be effective
in any calendar year until the aforesaid resolution, together with
its attachment, is adopted and published, subject to the sufficient
budgetary appropriation for salaries and wages and subject to any
collective bargaining, union or private agreement with the Board of
Health.
D.
The aforesaid certification shall include all employees
covered heretofore or hereafter by any collective bargaining, union
or private agreements with the Board of Health as well as all other
officials and employees.
A.
Effective January 1, 1973, each employee shall be
paid, in addition to his annual wage, a longevity increment based
upon years of service in the employ of Toms River Township or this
Board of Health, in accordance with the following schedule:

B.
Longevity payments shall be based upon the date of
employment of each employee in the same manner as annual increments
are determined as set forth herein.
C.
Any interruption of employment due to military service, injury arising from employment by Toms River Township or this Board of Health, or illness for a maximum duration of two years shall be included within the definition of "years of service" as set forth in Subsection A above.
D.
Said years of service shall not include any time spent
as a part-time or temporary employee, but shall only include time
spent as a full-time employee of Toms River Township or this Board
of Health.
E.
All longevity increments shall be subject to any collective
bargaining, union or private agreement with the Board of Health.
A.
Except as hereinabove provided, all employees of the
Board of Health, except department heads, who in any workweek shall
work in excess of 40 hours for such week shall be paid for such excess
of hours so worked at a rate 1 1/2 times such employee's prevailing
regular wage rate. Such overtime shall not be paid unless authorized
by the department head after approval by the Board of Health.
B.
All overtime benefits shall be subject to any collective
bargaining, union or private agreement with the Board of Health.
Any salary, wage or compensation not hereinbefore
mentioned shall remain the same as heretofore.
