The purpose of this article is to promote the
health, safety and general welfare of the Town of Highlands and its
inhabitants by regulating the disposal and collection of solid waste
and the recyclable components of solid waste in the Town of Highlands.
As used in this article, the following terms
shall have the meanings indicated.
RECYCLABLE COMPONENTS
Those components of solid waste determined by the Orange
County Commissioner of Public Works to be recyclable components, including
but not limited to:
SOLID WASTE
All putrescible and nonputrescible materials or substances
discarded or rejected as being spent, useless, worthless or in excess
to the owners at the time of such discard or rejection, including
but not limited to garbage, refuse, industrial and commercial waste,
sludges from air or water control facilities, rubbish, ashes, appliances,
contained gaseous material, incinerator residue, demolition and construction
debris, automobile engines and transmissions, but not including sanitary
sewage and other highly diluted water-carried materials or substances
or those in gaseous form.
The Town Board of the Town of Highlands shall,
from time to time, adopt resolutions prescribing which recyclable
components must be separated from the solid waste collected by and
disposed of by the Town of Highlands on behalf of the refuse and garbage
district of the Town of Highlands and the manner in which such recyclable
components must be prepared and separated, it being the purpose of
the Town to implement the policy of the County of Orange in regard
to the collecting and disposal of recyclable components and provide
guidelines for the separation and collection of such recyclable components.
All recyclable components shall be separated,
prepared and placed for collection in accordance with the resolutions
of the Town Board of the Town of Highlands. Any person who fails to
remove recyclable components from solid waste and prepare and place
the same for collection in accordance with such resolutions is guilty
of a violation of this article.

A violation of this article is punishable by
a fine of not more than $250 or imprisonment not to exceed 15 days,
or both.
