[HISTORY: Adopted by the Board of Trustees of the Village of Mill Neck 4-9-1955 by resolution; amended in its entirety 4-12-1994 by L.L. No. 1-1994. Subsequent amendments noted where applicable.]
A. 
Pursuant to § 7-718 of the Village Law of the State of New York, a Planning Board consisting of five members is hereby created in the Village of Mill Neck.
B. 
The terms of office of the original members shall be as follows:
(1) 
One for a term of five years.
(2) 
One for a term of four years.
(3) 
One for a term of three years.
(4) 
One for a term of two years.
(5) 
One for a term of one year.
C. 
Upon expiration of the terms of office of the original members, appointments shall be for terms of five years. One person shall be appointed annually to serve as Chairman of the Planning Board.
D. 
In addition, the Board of Trustees may appoint, for a one-year term, two alternate members to the Planning Board who shall be entitled to serve and function in the place and stead of a regular member on account of the absence or inability of a regular Board member to serve or function.

For the purposes of providing for the future growth and development of the village and affording adequate facilities for the housing, transportation, distribution, comfort, convenience, safety, health and welfare of its population, the Village of Mill Neck Planning Board is hereby authorized, pursuant to the Village Law, including § 7-728 thereof, to approve plats showing lots, blocks or sites, with or without streets or highways, within the village and to pass and to approve the development of plats already filed in the office of the Clerk of the county in which such plat is located if such plats are entirely or partially undeveloped. Said Board is also authorized, simultaneously with the approval of any plat, to modify applicable provisions of the village's Zoning Law, in accordance with and subject to the conditions of § 7-728 of the Village Law.
