GENERAL REFERENCES
Current permit fee — See Ch. A123.
No person shall cause or permit to take place on any public or private property in the Village of Mill Neck a garage sale, tag sale or auction or any other similar performance or display without first obtaining a permit therefor from the Village Clerk.
All applications for a permit pursuant to this section shall be made in writing, under oath, and shall be filed with the Village Clerk not less than 20 days before the proposed activity and shall contain a full and complete statement of the proposed activity and shall set forth therein the following:
A. 
The name and address of the applicant.
B. 
The name and address of the person responsible for the conduct of the proposed activity.
C. 
The number of persons expected to attend.
D. 
The details with respect to sanitary facilites, if needed.
E. 
The details of provisions for off-street parking.
The fee for such permits shall be in the amount as set forth in Chapter A132, Fees, which fee may be waived by the Board of Trustees when such garage sale, tag sale or auction is for a charitable, noncommercial or community event.

An applicant may not apply for or receive a permit if a previous permit had been issued within a twelve-month period of a previous application, unless so ordered by the Board of Trustees upon a written application to vary the twelve-month requirement. The duration of a garage sale, tag sale or auction shall not exceed four days within a ten-day period.
The Village Clerk may issue such permits subject to the aforementioned conditions and further conditions as the Chief of Police may deem to be reasonable to protect the residents of the area from noise and inconvenience, to preserve the residential character of the village and otherwise to further the public intent and general welfare and ensure compliance with all village ordinances, regulations and local laws.
Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
