This chapter shall be known and may be cited as the "Subdivision and Land Development Ordinance of Derry Township."
The purpose of this chapter is to insure the harmonious, equitable, economically sound and environmentally sensitive development of the Township in order to promote the health, safety and welfare of the citizens of the Township by:
A. 
Establishing a coherent process for orderly review of proposed subdivision and land development activities.
B. 
Providing uniform standards to design proposed subdivision and land development activities in a manner consistent with the goals of the Derry Township Comprehensive Plan.
C. 
Protecting Derry Township's water resources, drainage ways and other environmentally sensitive areas.
D. 
Facilitating safe and efficient transportation.
E. 
Providing for a mixture of housing types to serve all citizens of the Township.
F. 
Ensuring the efficient and orderly expansion of Township and other community services.
A. 
This chapter has been enacted by the Township of Derry Board of Supervisors under authority of the "Pennsylvania Municipalities Planning Code," Act No. 247 of 1968, Article V, §§ 501 through 515, as amended.
B. 
The Derry Township Board of Supervisors shall have the authority to approve or disapprove all preliminary and final subdivision or land development plan applications as required herein.
C. 
The Derry Township Planning Commission is hereby designated as the agency which shall review and make recommendations regarding all subdivision and land development plan submissions as required herein prior to action on same by the Board of Supervisors.
Applications for subdivision and land development activities located within the Township of Derry shall be forwarded upon receipt, with the appropriate review fee, to the Dauphin County Planning Commission for review and report. The Board of Supervisors shall not approve such applications until the County review report is received or until the expiration of 45 days from the date the application and review fee was forwarded to the Dauphin County Planning Commission.
A. 
No subdivision or land development of any lot, tract or parcel of land located in Derry Township shall be made; no street, sanitary sewer, storm sewer, water main or other improvements in connection therewith shall be laid out, constructed, opened, or dedicated for public use or travel, or for the common use of occupants of buildings abutting thereon, unless and until a preliminary subdivision and/or land development plat, or a master plan under the requirements of § 225-501.58 of Chapter 225, Zoning, as may be required, has been approved by the Board of Supervisors and publicly recorded in the office of the Dauphin County Recorder of Deeds.

(1) 
Derry Township shall not enter into an agreement with a utility company to provide fire hydrant service or street lighting facilities until such time as a final subdivision or land development plat, as may be required, has been approved by the Board of Supervisors and has been publicly recorded in the office of the Dauphin County Recorder of Deeds.
B. 
No lot in a subdivision may be sold or offered for sale; no permit to erect or alter any building upon land in a subdivision or land development may be issued; and no building may be erected or altered in a subdivision or land development, unless and until a final subdivision or land development plat, as may be required, has been approved by the Board of Supervisors and recorded, and until construction of common or public facilities proposed in conjunction with such subdivision or land development have been constructed or has been guaranteed to be constructed in the manner prescribed herein.
C. 
Unit or condominium subdivision of real property is included within the meaning of subdivision and land development as defined herein, and must comply with these regulations.
In interpreting and applying the provisions of this chapter, the provisions shall be held to be minimum requirements for the promotion of harmonious, equitable, economically sound and environmentally sensitive growth. Where provisions of this chapter impose greater restrictions than those of any statute, other ordinance, restriction or regulation, the provisions of this chapter shall be controlling. Where the provisions of a statute, other ordinance, resolution or regulation imposes greater restrictions than this chapter, the provisions of such statute, resolution, ordinance or regulation shall be controlling.
