A.
The Board of Supervisors may grant a modification
of one or more of the provisions of this chapter when literal enforcement
thereof will be unreasonable, will cause undue hardship because of
peculiar conditions pertaining to the land in question, or when an
alternative standard can be demonstrated to provide equal or better
results; provided, that such modification will not be contrary to
the public health, safety and welfare and that the purpose and intent
of this chapter is observed.
B.
All requests for a modification of requirements shall
be in writing, and shall accompany the application for a plan submission.
The request shall state in full the grounds and facts of unreasonableness
or hardship on which the request is based, the provision of this chapter
involved and the minimum modification necessary.
C.
The Planning Commission may offer advisory comments
to the Board of Supervisors relevant to the granting of a modification
of requirements.
D.
The grant or denial of a modification of requirements
shall be recorded in the minutes of the Board of Supervisors meeting
where the action is taken. The Board of Supervisors may attach reasonable
conditions to the granting of a modification of requirements.
