GENERAL REFERENCES

The following words and phrases when used in
this article shall have the meanings given to them in this section
unless the context clearly indicates otherwise.
Includes any motorized vehicle and/or conveyance capable
of carrying and/or transporting one or more human beings including
motorcycles, dirt bikes, three-wheel vehicles, four-wheel vehicles
and other "off-road" motorized vehicles. Motorized vehicles shall
not include radio-control cars, boats, planes not capable of conveying
and/or transporting human beings, and also does not include motorized
wheel chairs for use by the physically impaired.
Includes all property owned by the Township which is open
for use by Township residents for recreational purposes, including
any land and/or facilities leased by the Township for this purpose.
Includes all facilities owned and/or leased by the Township
for use by members of the public for recreational use and enjoyment,
including all baseball and/or soccer fields and parks, including the
Maidencreek Township Community Park.
Any personal property or equipment not owned by the Township,
intended for recreational use and shall include but not be limited
to basketball nets, whether portable or fixed, hockey nets and/or
goals and related equipment, basketballs, skateboard ramps and jumps,
and any and all other personalty commonly used for sports or recreational
activities.
All public roads, streets and/or thoroughfares to the full
width of the traveled portion and/or paved portion thereof from curbline
to curbline.
A.Â
It shall be unlawful and a violation of this article
to do any of the following:
(1)Â
To use or employ sports equipment on any street;
(2)Â
To use or employ any sports equipment on any private
or public property closer than eight feet from the edge of any street
as defined in this article;
(3)Â
To place any sports equipment on or closer than eight
feet to any street;
(4)Â
For any property owner or tenant to allow any sports
equipment to be placed on property owned or occupied by them on or
closer than eight feet to any street;
(5)Â
To place on private or public property any sports
equipment in such a way that all or any portion of the playing field
or play area is on any portion of a street as defined in this article;
(6)Â
To block any sidewalk with or while using sports equipment.
B.Â
It shall be unlawful for any person to engage in any
of the actions described above and violators shall be liable for the
penalties set forth below.
It is unlawful for any person to use, ride upon
or employ any motorized vehicle on any Township open space or any
Township park. Any person violating this prohibition shall be liable
for the penalties set forth below.
No person shall enter upon or remain on any
Township open space and/or Township park earlier than 1/2 hour before
sunrise or later than 1/2 hour after sunset. At all other times, Township
open space and Township parks are considered closed and entry upon
and/or use of the open space and/or Township park during any period
when the same is closed shall be a violation of this article. No overnight
parking of vehicles shall be allowed without prior written approval
of the Board of Supervisors. Notwithstanding the foregoing, any open
space or park containing Township-installed and approved artificial
lighting that is intended to permit recreational activity after sunset
shall remain open until the lights are extinguished at the end of
any activity or event.
The terms of this article shall be enforced in accordance with the Second Class Township Code, Article XVI, Section 1601(c.1)(2)[1] by the Township Code Enforcement Officer and/or the Northern
Berks Regional Police Department.

the use of propellant such as gunpowder. The term includes, but is
not limited to, a pistol, a rifle, a handgun and a shotgun.
Includes any motorized vehicle and/or conveyance capable
of carrying and/or transporting one or more human beings including
motorcycles, dirt bikes, three-wheel vehicles, four-wheel vehicles
and other "off-road" motorized vehicles. Motorized vehicles shall
not include radio-control cars, boats, planes not capable of conveying
and/or transporting human beings, and also does not include motorized
wheelchairs for use by the physically impaired.
Includes all property owned by the Township which is open
for use by Township residents for recreational purposes, including
any land and/or facilities leased by the Township for this purpose.
Includes all facilities owned and/or leased by the Township
for use by members of the public for recreational use and enjoyment,
including all baseball and/or soccer fields, tot lots, and Maidencreek
Township Community Park.
Includes any animal that is tamed or domesticated.
A.Â
No person shall enter upon or remain on any Township
open space and/or park earlier than 1/2 hour before sunrise or later
than 1/2 hour after sunset. At all other times, Township open space
and parks are considered closed and entry upon and/or use of the open
space and/or park during any period when the same is closed shall
be a violation of this article.
B.Â
No overnight parking of vehicles shall be allowed
without prior written approval of the Board of Supervisors.
C.Â
Notwithstanding the foregoing, any open space or park
containing Township-installed and approved artificial lighting that
is intended to permit recreational activity after sunset shall remain
open until the event lighting is extinguished at the end of any activity
or event.
The following activities are prohibited in Township
open space or parks:
A.Â
The use of, riding on, or employing any motorized
vehicle;
B.Â
Loitering or littering;
C.Â
Use of foul language;
D.Â
Fires, except those in containers designed for cooking;
E.Â
Camping;
F.Â
Soliciting or peddling;
G.Â
Possession or consumption of alcoholic beverages;
I.Â
Possession or discharging of paint ball guns, pellet
guns, bow guns; bow and arrows and/or cross bows, unless the person
wishing to possess or discharge any of the foregoing obtains written
permission from the Chief of Police or the Township Board of Supervisors
prior to the activity;
J.Â
Possession or discharging of firearms, unless:
(1)Â
The firearm is being carried by a duly authorized
law enforcement officer;
(2)Â
The firearm is being carried by U.S. Armed Forces/U.S.
Reserves as part of official duties and/or functions;
(3)Â
The firearm is being carried by a person duly authorized
by law and holding a valid and current permit for the same, issued
by the Sheriff's Department of Berks County or other appropriate official;
or
(4)Â
The person wishing to possess or discharge a firearm
obtains express written permission from the Chief of Police or the
Township Board of Supervisors prior to the activity.
K.Â
Posting signs, defacing and/or damaging property;
L.Â
Immoral, indecent, and/or disorderly conduct; and
M.Â
Horseback riding.
Pets are permitted in any Township open space
and/or park, provided that any pet waste matter be immediately picked
up and properly disposed of by the handler of the pet.
