A. 
The term "Town-based business" shall mean a business with a principal place of business located within the Town of North Haven.
B. 
A business shall not be considered a Town-based business unless evidence satisfactory to the First Selectman has been submitted with each bid, submitted to establish that business has a bona fide principal place of business in North Haven. Such evidence may include evidence of ownership of, or a long-term lease of real estate from which a principal place of business is operated, or payment of property taxes on the personal property of the business. A Town-based business shall maintain such status throughout the term of any contract with the Town of North Haven. Failure to maintain such status shall be grounds for the Town to terminate said contract.
On any contracts for the purchases of personal property or for personal services advertised for bid pursuant to Section 406 of the Charter of the Town of North Haven, the lowest responsible bidder shall be determined in the flowing order:
A. 
On purchases the cost of which is $1,000,000 total contract price or less, any Town-based bidder which has submitted a low bid not more than 10% higher than the low bid, provided such Town-based bidder agrees to accept the award of the bid at the amount of the low bid. If more than one Town-based bidder has submitted bids not more than 10% higher than the low bid and has agreed to accept the award of the bid at the amount of the low bid, the lowest responsible bidder shall be that one of such Town-based bidders which submitted the lowest bid.
B. 
On purchases the cost of which is over a $1,000,000, but less than $5,000,000 total contract price, any Town-based bidder which has submitted a bid not more than live 5% higher than the low bid, provided such Town-based bidder agrees to accept the award of the bid at the amount of the low bid. If more than one Town-based bidder submitted bids not wore than 5% higher than the low bid and has agreed to accept the award of the bid at the amount of the low bid, the lowest responsible bidder shall be that one of such Town-based bidders which has submitted the lowest bid.
C. 
On purchases the cost of which is over $5,000,000 total contract price, any Town-based bidder which has submitted a bid not more than 3% higher than the low bid, provided such Town-based bidder agrees to accept the award of the low bid at the amount of the low bid. If more than one Town-based bidder has submitted bids not more than 3% higher than the low bid and has agreed to accept the award of the bid at the amount of the low bid, the lowest responsible bidder shall be that one of such Town-based bidders which submitted the lowest bid.
D. 
The responsible low bidder.
The Town of North Haven's policy on Town-based businesses, namely that the Town reserves the right to award bids on the basis of this article concerning Town-based businesses, shall be stated in the invitation to bid.
Sections 32-4 to 32-6 shall not apply in those instances where the invitation to bid involves purchases through a consortium, through cooperative agreements with other local, state or federal agencies, state bid (DSA) prices or federal (GSA) bid schedules or any other similar arrangements precluding the need for local, unilateral bidding.
This article, once adopted, shall apply only to local bids solicited, or contract placed unilaterally by the Town. Under no circumstances will an existing contract with a vendor be replaced solely for reasons enumerated in §§ 32-4 and 32-5.
