City of Butler, PA Chapter 26 Educational Service Agency

§ 26-1 Definitions and word usage.

A. When not inconsistent with the context, words used in the present tense include the future, words in the plural include the singular number and words in the singular include the plural number. The word "shall" is always mandatory and not merely directory.

B. For purposes of this chapter, the following terms, phrases, words and their derivations shall have the meanings given herein.

CHIEF OF POLICE

The Chief of Police of the City of Butler.

CITY

The City of Butler.

EDUCATIONAL SERVICES AGENCY

A City of Butler agency established and operated exclusively for the purpose of providing protection to those attending various educational institutions by maintaining the orderly movement of pedestrian and vehicular traffic within the city.

GUARD

An adult school crossing guard appointed under the authority of this chapter.

§ 26-2 Adult school crossing guard established.

A. There is hereby established in and for the City an adult school crossing guard.

B. The adult school crossing guard is and shall constitute an educational service agency.

§ 26-3 Appointment of guards.

The Mayor shall have the authority and is hereby authorized to appoint 21 persons to be known as adult school crossing guards. Council may from time to time increase or decrease the number of adult school crossing guards.

§ 26-4 Qualifications of guards; oath.

A. To be eligible for appointment to the adult school crossing guard, a person shall be:

(1) Not less than 18 years of age.

(2) A resident of the City.

(3) A citizen of the United States, of good moral character and able to read and write the English language understandably.

(4) In good health, sound in body and mind and certified by a reputable physician as being physically capable of performing the required duties.

B. Each appointee to the adult school crossing guard shall be sworn to faithful performance of the required duties.

§ 26-5 Preassignment training.

The Chief of Police shall conduct and guard appointees shall present themselves for a period of preassignment formal training of such intensity and duration as the Chief of Police shall find necessary to the performance of the required duties.

§ 26-6 Assignment to localities.

The Chief of Police shall have the authority to assign guards to such localities as shall be best suited to afford protection to those attending school.

§ 26-7 Duty hours; salary designations.

A. Guards shall perform their duties at the locations and during the hours as assigned by the Chief of Police when either the parochial or public schools in the city are in session.

B. Guards assigned to a three-and-three-fourths-hour daily tour of duty shall be designated for salary purposes as full-time school crossing guards, and those assigned to a two-and-one-half-hour daily tour of duty shall be designated for such purpose as part-time guards.

§ 26-8 Guard duties.

A. Guards shall maintain the orderly movement of pedestrian and vehicular traffic consistent with the safety of children attending school in the City.

B. The Chief of Police shall familiarize each guard with the duties to be performed and he shall be the sole supervisor of the duties of guards.

§ 26-9 Compliance with official regulations.

Guards shall adhere to and be governed by all the rules and regulations laid down for the guidance of the Police Bureau members insofar as such rules and regulations are applicable to and consistent with the special class of duty prescribed for adult school crossing guards. Guards shall also comply with all other applicable ordinances, rules and regulations adopted by Council.

§ 26-10 Status of guards.

Guards shall not be a part of or affiliated or connected in an official capacity with the City Police Bureau. Guards shall not be subject to, or acquire any rights under, the civil service rules of the state or the city. Guards shall be considered as part-time employees of the city for all purposes.

§ 26-11 Badge and equipment.

The Chief of Police shall, at the expense of the city, supply each guard with a suitable badge and uniform and such other equipment or supplies as he shall find necessary in the best interests of the city.

§ 26-12 Compensation.

Guards shall be paid such salary or hourly wage by the city as may from time to time be fixed by Council.

§ 26-13 Dismissal.

The Chief of Police shall have the authority to dismiss guards when he finds such dismissal to be in the best interests of the city. Council shall have the authority to summarily dismiss any guard for any reason it shall deem sufficient. Vacancies shall be filled in the manner of original appointments.

§ 26-14 Sick leave.

A. Guards with more than one year of service shall be entitled to 14 work days' sick leave per calendar year, without diminution of salary or compensation. Such sick leave shall not be accumulated from year to year and shall be granted only for bona fide sickness confining the guard to his home, hospital or other place of proper care, which fact shall be duly certified to the City Controller by the Chief of Police. Sick leave in excess of three consecutive days shall be granted to a guard only on presentation of a signed certificate from the attending physician upon a form provided by the city. Council shall have power to establish and enforce reasonable regulations as to the use of such sick leave for the purpose of preventing the abuse thereof.

B. Guards appointed after December 31, 1984, shall not be entitled to salary or compensation except for time actually worked. Subsection A hereof shall not apply to guards appointed after December 31, 1984, but shall continue to apply to guards appointed prior to such date.
